Is TONS of evidence really necessary for I-751?

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

absolutely my husband and I brought 1 picture to our interview and apparently it wasnt enough so we had to go through our instagram profiles, show them our adoption of our cat on the humane society IG page and show them our keys were the same.

This right here demonstrates how utterly ridiculous this is.

What if you didn’t bring your key because you travelled there & back together? What if you had an electronic key fob or keypad/thumb pad/app instead of a physical key ? What if you live in a fancy Manhattan apartment building which doesn’t need keys because it has a full time doorman?

@Reed1812 I would just send one G-1145 to get text message notifications. You can always create two USCIS accounts to get updates if you would like. That's fine. :)

well it gets worse, because of the pandemic and lockdowns and the fact i had a job the conditional green card expired. I have to go through the process again to file for cr1 and who knows when my I -130 will be even approved......in the meantime i have been told i cannot enter the usa to see my husband to see my husband and the B2 visa isnt possible because the embassy in London has been closed (who knows when that will ever open again). The system does not work

@Reed1812 we added a copy of the marriage certificate as proof of family relationship between the petitioner and US citizen spouse. The I-751 does not state it is required but it seems like everyone includes it, so we did. Same with the US citizen's passport. We included it.

@kittykat88Did you officially abandon your permanent resident status? I am wondering if you can just apply for a returning resident visa (SB-1) instead of starting over with the I-130.

No I did not officially abandon my permanent residence. I am not eligible for a returning resident visa since i was a conditional greencard holder (not a permanent holder). The embassy website specifically states this and technically I could have taken a flight (I wasn't in hospital nor was i incapacitated) I chose not to risk it because of the pandemic and my employment at the time so in USCIS eyes the argument won't hold and i don't fancy exaggerating the truth to an immigration officer. I am hoping that given i already have an A number it may go a little quicker or maybe they will be offended by the fact my green card expired LOL without filing for adjustment of status.

Unfortunately USCIS officer said that given the facts and circumstances I would need to start over. Given I have an A number that whilst its technically abandoned there is an A number so CBP told my spouse that I would have serious issues at the port of entry. A B2 visa is an unlikely dream atm as the embassy told me they are not open to normal processing/ appointments and reopening is a TBD. I do feel a little panicky at the moment and a little uncertain about the next few months. I am just thanksful i have a good job in London and I have my health.

@kittykat88 It is interesting they told you that a conditional green card holder does not qualify for a returning resident visa. This person had a conditional green card and stayed out of the US for longer than a year. It seems maybe the issue was that you did not have an emergency/reason to justify staying outside the US for longer than 1 year.

Sorry, to be clear here and to other prospective readers who may want to file for a returning visa - I wasn't eligible for the returning visa because my green card had expired and I hadn't filed for the adjustment of status given I was living in the UK at the time. The story above is different - her CR1 is still in date.

 

Fortunately I also had no personal emergency (outside of pandemic) I was working hard in London and couldn't take time out of my life to go and sit in the USA and file for a re entry permit. One can say it is just life right? Those are the consequences of living life and working in different countries. As the saying goes, keep calm and carry on.

The issue was probably that she didn't file for ROC, so her status was terminated.

Thank you @Scandi. I agree. It seems that the other case stayed outside of the US for a year and filed for the SB-1 before the conditional green card expired. That makes sense.

Yes exactly (I explained this in full on a previous reply). I am perfectly fine with having to file again...I am simply wondering if anyone has done this recently and if so how long does it take? Any info much appreciated. Thank you.
