Is TONS of evidence really necessary for I-751?

I just looked back at our K1 visa application (1-129F petition): 83 pages. In addition to the required stuff (passport pages, letters of intent to marry, etc.) I also sent documentation of all of our visits to each other (receipts, boarding passes, photos of me with him and his relatives, bank statements showing charges from trips), and a section of evidence of ongoing relationship (phone call records, emails, handwritten letters, a few affidavits attesting to our relationship from people who knew us). Not a ton of each thing, but a well-organized (I used section cover pages listing everything in each section, and also labeled everything with locations, dates, people shown, etc.) representative sample.

 

(Just realized this thread is in a ROC forum: ROC package was 107 pages; list below.)

 

No RFE; no issues at Nairobi (which can be a tough embassy), and never interviewed again until naturalization 8 years later.

Nov. 15, 2012: Visa in hand (was ready for retrieval 11/12/12)

Nov. 20, 2012: POE, Boston!!! (legal marriage 12/12/12; family/friends wedding ceremony 1/12/13) (276 days)

AOS/EAD/AP

Feb. 4, 2013: AOS packet sent (delivered 2/6, NOA1 text/email & check cashed 2/11 midnight)

Feb. 11, 2013: NOA1 notice date for I-485, EAD, AP (I-485/EAD NOA1 hard copies & biometrics appt letter arrived 2/16, badly mangled AP NOA1 arrived 2/27; biometrics done 3/4/13)

Apr. 3, 2013: EAD & AP approved (received card 4/11)

Aug. 16, 2013: I-485 approved & green card production ordered!!!! (card arrived 8/26/13) (193 days)

ROC

2015 sometime? I've slept since then.

Naturalization

Dec. 20, 2019: N-400 submitted online (Boston, MA field office)

Jan. 9, 2020: Biometrics

Feb. 4, 2020: updated wait time = 4 months (estimated case completion June 2020)

Aug. 7, 2020: interview scheduled (!), but no idea when

Sept. 16, 2020: interview, Boston (approved)

Sept. 24, 2020: oath ceremony, Boston---DONE!!! (279 days from submission)

This may be a little off topic, and I haven't searched yet, but I will be filing ROC in October, or getting it ready to mail Early November. Can you print stuff on both sides of the pages. Most of our joint account statements and stuff is like 4 pages, and if I print front and back it obviously keeps the package smaller( Only 2 pages). I would like to thing they have decent document scanners that can do both sides of each page, but has anyone sent supporting evidence printed on both sides of the pages without any issues? Thanks in advance!!

 

I found some threads from 2018 that were kinda back and forth on the double sided thing. Guess I will see if someone has some more current information here.

I believe they have to be single pages from what I remember reading.

FROM USCIS:

  • Supporting documentation:
    • Submit the documents or evidence listed in the form instructions.
    • Supporting documents must be in English or accompanied by a complete English translation.
    • Submit copies unless we request original documents. If you send an original document with your form, it may become part of the record and we will not return it to you automatically. 
    • If you have any attachments, make sure each attached page has your name and A-Number (if any). You may also number the pages and include the total amount of pages being attached (for example, “page 1 of 11”).
    • Send single-sided copies of your supporting documentation.

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Well, I prefer they do their damn job properly - but you can’t always get what you want.

Yes, you can. It all gets scanned - all of the double sided documents that I previously submitted are in my FOIA correctly, in page numbered order.

 

Written stuff? Affidavits? Photos? Document scans? Keep it single sided.

But lots of stuff like bank and card statements come as standard printed double sided - Amex statements do for example - so having to make single sided duplicates would be kinda stupid, and a complete waste of paper (not that this entire process isn’t a colossal collective waste of paper)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thanks, that is what I wanted to know. I understand the actual forms, photos, documents should be single sided, but like you said the bank statements, utility bills, credit card statements, etc. come as standard double sided, and that is where I was looking to save some paper. But from your previous posts in this thread I see that wasn't your biggest concern.... LOL. Thanks for your help, and good luck with your on going journey. I wish I could have been there when your Fed-Ex box showed up. That had to be a priceless moment. But I feel so bad you had to go to such extreme measures, but it will pay off in the end.

Thank you for all your posts. I have finished putting my package together ready to be mailed on Monday, end total is approx. 100 pages including the form itself. I will let you know how it goes, with being a K1 and based in Texas I am hoping it goes to the Texas office for a speedy response.

 

With my adjustment of status I remember sending a form that agreed to text message updates. Is there a similar form available for the ROC?

I honestly don't know.... their system may only allow it to do once per receipt number, so it may be more trouble than it is worth trying to do that.

Most likely no, as only the applicant/petitioner/beneficiary (all three are the same person) himself is supposed to get updates about his case. Either way, this form is ONLY for the acceptance of the case, you won't receive any other notifications after that point (if you want them you need to get an online account and change your settings there, or simply download a case tracker app and get notifications from that one instead. You and your wife can have this app on both your phones, so both of you get updates).

One more thing. I see a few people have added their wedding certificate to the ROC. 

 

USCIS had this for my first AOS, is it necessary again?

No, not needed. I sent a regular photo copy "just because", didn't cost me many pennies.
