Is TONS of evidence really necessary for I-751?

There's no specific requirement of what you have to send, or how much you have to send. You do you.

Personally I wasn't going to take any chances and sent a ~3 inch pile of documents, the majority was every single bank statement of our joint bank accounts from the time we got married until the ROC filing date. 

I chose to "be on the safe side" as with everything in my whole immigration journey to try my best to avoid any issues or delays, this still doesn't mean you're guaranteed to not receive an RFE. There were several in the April filers thread who received RFEs despite the fact that they sent in great evidence, and a lot of it.
Sometimes there has simply been so much time between the date of filing and the date they pick up your petition to go through it, that the person looking at your case wants to ensure that you're STILL in a bonafide marriage, living together etc. A lot can happen in 2 years, and even 1 year. 

It's up to you how you want to do it. You can't possibly know if your case will end up with someone picky who will ask for more evidence, or with someone who's fine with what you already sent. You can only try to avoid an RFE, but if you do get one it's not an issue bigger than a simple delay. An RFE and delay is not that big of a deal.

Wow. That sounds like a full time job pulling all that information together!

 

I have just printed the two years tax returns and I am looking at 66 pages already. Man.

@mindthegap This is not to discredit your struggle. On the upside, though, I am glad that you have the evidence to back it all up. Often times, psycho spouse strikes and the immigrant is caught off guard and can't access evidence or moves out without it. So I am glad you were able to gather all that evidence of bona fide marriage.

Honestly if it had been twice that it would have gone in. Sick to f***ing death of this whole thing at this point… I could have put more, but I had to draw a line and cap it for my own sanity.
Spending a solid full time three and a half months thinking about, re-living in detail and writing about a toxic & abusive marriage to a thoroughly nasty person that I haven’t seen or spoken to in over half a decade (and I assure you I never will again) was not how I wanted to spend my spring. It was basically a full time job. 
But, if it brings about an end to this seemingly never-ending nightmare it will be worth it.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

in contrast, filing #1 fit comfortably into a fedex express box, and #2 in a Fedex express envelope.

 

 

 

 

I know because I kept having to re-order printer paper (and ink).... in total I ordered 7 reams of 500 pages = 3500 sheets. Allowing for mis-prints/duplicates, and what was left over,  I used well over 2500 sheets....and then if you add on the load of stuff that was printed double sided (mainly credit card and bank statements), I printed well over 4000 sides of paper. 

I also wore out a brand new printer so had to buy another one.

 

 

There was definitely stuff like that in mine, within the mountain of other correspondence, along with the not so nice messages to/about me, of which there were plenty. It's all truthful, so it all went in. 

 

 

Ayayeeee 🙆‍♂️. I knew it. I hope you paid USCIS 10x the usual fee to review this.

 

The person that I know who sent one form will be surprised.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Check your returns to make sure you haven’t included extra pages and “worksheets”. I know my TurboTax creates a pile of pages that are not actually part of the return. Except for form 1040, all the other included forms or schedules will have the  Attachment Sequence number (examples below). Those are the ones that are actually part of the tax return. Anything else is extra for your records or the bin.

There's no one correct answer, but it's definitely quality over quantity.

 

 

My packet fit into one of the USPS priority express envelopes, and I was approved today without an interview or RFE.

 

 

I didn't send a lot in, because I waited until the last minute to haphazardly throw my packet together, and mail it out until two weeks before my packet expired. 

 

 

What I submitted was our health insurance information, joint tax returns, the car loan documents for my car, vehicle insurance, our internet bills, 4 pictures (two were old, and two were our cats, lol) a few paystubs to show we live at the same address, and that's about it. 

 

 

I'm not on the mortgage, or most of the bills, we didn't have any joint accounts, have almost no pictures together, and we were still fine. Don't overthink it too much! 😊

I think it comes down to what is going to help you sleep at night. I know that I would not be able to sleep if I'd sent 4 bank statements per year. I just wouldn't. So we sent everything but the kitchen sink.

This is going to be our M.O.  My husband is from New Zealand, and if we were not together, there is no way he'd stay in the US 😂.   I was thinking I should probably do a quit claim gift for his part of the house, though.

Quality over quantity. My husband and I had several so called "red flags" and I never sent huge amounts of evidence at any stage of our journey and we never had a single RFE at any point-up to and including naturalization. There is no need to send every page of every statement from all of your joint accts, insurance, mortgages, ect..just send a sampling of them that span the entirety of the time that your spouse has been in the U.S. There is no need to send anything from before he/she arrived, you've already sent that all in at the petition, NVC and visa stages.

 

(Our "red flags:" I'm 21 years older, divorced with 2 children. We are different religions, we married on my first visit to meet him and I'm sure there were more but I just can't think of them at the moment)He's been a citizen for several years now and this year is our 10th wedding anniversary. And yes, we're very happy. :)

Really makes one ponder about what a joke the I751 really is.
