Hello everybody

My wife finally went for her interview and all the documnets were found to be just fine. I want to bring this to your attention that she was questioned over and over only on one topic during the interview. And that was concerning my past relationships. She felt that it was a mental torture especially with remarks like that I don't even want to post here.

At the end of the interview, she received the following notice.

The consulate general regrets it is unable to issue a visa at this time. Section 221(g) of the US immigration and nationality act prohibits the issuance of a visa to anyone who has failed to present the documents required in connection with their visa application, or who has otherwise failed to meet the requirements of U.S. law or regulations governing the issuance of visa. The following remarks apply in ur case:

You are required to submit the following documents:A list of all the beneficiary’s and petitioner’s relatives living in US and India, with complete contact address address information, telephone and dates of birth (includes cousins, aunts, uncles, brothers, sisters, parents, grandparents, grandchildren, children, nephews, and nieces, and all in laws). For those relatives who live in the US but not born there, describe how they went to US, when, under what visa type, and the names they used when they immigrated. Please provide family names.

So my questions are as follows:

1.What if we give them the name of only our close relatives.? Would they object to the fact that we have not provided the contact info for everybody? As you might know, in Indian families, not all the relatives get along too well. Even if we tell them that we do not deal with such and such relative,would they raise any substantial doubt. Is that a good answer that we don't deal with them anymore. Some of these people have attended the wedding.( please know that our case is Genuine. It is just that a lot of our relatives are jealous with us big time)

2. What if we are unable to obtain dob from our relatives?

SOMEBODY PLEASE HELP.I AM SO LOST RIGHT NOW AND DON'T KNOW WHAT TO DO.PLEASE HELP

This must be very upsetting. Unfortunately, this is a case where they've said jump and told you exactly how high. You must do the very best you can to do exactly as they have told you. They have a reason to suspect visa fraud. It may be a case of mistaken identity. This happens often.

If you don't have complete information on a person, give them what you have. For China, a family composition sheet called a GIV-24 is used for a similar purpose but it is required of all applicants. I have a brother who nobody heard from for 10 years. Under current address, I put disappeared in 19XX. I have a former spouse I haven't seen or dealt with for 15 years. For current address, I indicated "unknown since 19xx." Either you or your wife may or may not have a clue as to why this has happened. If you do, it's time to come clean. In any event you do the best you can and supply the information as quickly and accurately as you can.

I'm no expert at all, but since your process is now out of the normal process, it may be worthwhile to contact a lawyer. There are services where you pay a fee to speak with an Immigration lawyer for a fixed price.

First of all do not panic and give the consulate the information that they are requesting. This is a very common request from this consulate and once you submit your information for them to check they will continue processing your file. Being your case is a CR1 they are having to do the AOS processing at the embassy level instead of applying for the EAD stateside so a 221(g) is normal since they do not issue the visa at the time of the interview.

As a note too I have noticed that ladies are getting put more and more into AR/AP and there is a new security check that took effect last year and I think this is the reason for this new delay. It is listed on Ammensity International website as well. It is called "Material Support".

Also, a lawyer, congressman or senator cannot help to expedite the AR/AP that you are in with the 221(g) since it is considered a matter of National Security since they are running your name and fingerprints during this process as well.

I know how devastating this feels since my husband and I got a 221(g) back in 2005 after his interview and we were at a loss so I am praying for you to have patience and understanding during this time as well as a speedy AR/AP.
