I am a tourist visa holder, currently adjusting status. I entered in March 2021, then my personal situation changed because of a lockdown imposed by my home country. I decided to get married to my US citizen fiancé and stay in the US. No issues so far. My green card interview is this August.

Many have.  This forum is full of them.  If it was not legal, we would be able to even discuss it, since it is a direct violation of the terms of service to discuss illegal immigration activities here....and the moderators here are very strict. Good luck.

But as you said, you have the documentation showing the major change in your life situation (leave extension), so I would file the I485/I130 as soon as you can.  As others have said, and as what you will find in the forum for adjusting from other visas, many have already done this.

Good Luck!

Thank you everyone. I wish I knew about this group before as I have wasted time worrying and reading online articles was not very helpful. You guys are awesome! Thanks for your responses I really appreciate! I'm starting to file very soon. Could anyone please share me a link me of a thread on how to start ? Is online filing or mailing better these days? Do you recommend premium processing? TIA

There is no fully-online filing option. The only 2 options are:

  • File I-130 (with I-130A supplement uploaded) online and then the rest of the forms by paper; or
  • File everything together by paper.

I recommended the 2nd option. I-130 and I-864 are filled-out by the US citizen, and the rest of the forms by you. In general, send the following four packets (*note that I-765 and I-131 packets are optional, but highly recommended) in the same envelope to the Chicago Lockbox:

  • I-130 with I-130A and copy of marriage certificate, filing fees, etc.;
  • I-485 with I-864 and supporting documents, electronic I-94 copy, filing fees, etc.;
  • I-765 with electronic I-94 copy, etc.; and
  • I-131 with electronic I-94 copy, etc.

You'll separate each packet with rubber bands or fasteners: https://www.uscis.gov/forms/forms-information/form-filing-tips

On the I-130 packet, I-130 payment method (check, money order, or Form G-1450) must be the very first item of this packet.

On the I-485 packet, I-485 payment method (check, money order, or Form G-1450) must be the very first item of this packet.
