My visa status is currently in removal proceedings because I had a hiccup with divorcing and tried to get that done before applying for new visa.

I am in a new relationship and we planned to marry and reapply under court orders. But he informed me today that he no longer wants to marry and left me alone with our 2yr old child and no way to work. I need a copy of my SSN but of course, SS offices will not help due to my visa being expired.

I am thinking the best thing to do is leave. I have a passport still valid but my daughter does not have passport.

Can I just request that immigration sends me and my daughter home? How can I proceed now?

  1. you need a lawyer
  2. if the child is a USC from either of these men,  you can not take the child out of the country without his permission
  3. and since the child does not have a passport,  i think we can assume she was born here and has a USC father

I was thinking the same thing.

Not necessarily a USC father.  Plenty of non citizen males running around.

but born here makes the baby a USC

and since baby has no passport to come here when she came,   must be USC

You need a family law attorney, you cannot apply for child's passport without notorized documents from biological father.  Furthermore, if you have a immigration lawyer handling your removal, you need to talk to them about voluntary departure.

Being born on US soil would make her a US citizen. Is the father's name on the birth certificate? If so both of you will have to sign the passport application.

Not sure about that.  I don’t recall for example signing anything to renew our kiddos Indonesian passports.  They are dualies, like this little girl probably is.

There is too little information here to provide OP with an answer.

Didn't say the child wasn't a usc.  You simply made a bad assumption about it must've been a usc father

YMMV

Op, we really need you to complete the timeline to help you better. Did you ever adjust your status in the US?

why do you need a copy of your SSN? Do you not have one? Also, that is useless for work. You Can’t use your SSN to Work if you don’t have work authorization or a green card. Also, you need the father’s authorization in order to Take the infant outside of the US. This is not a DIY. Lawyer up

Both parents have to consent for a USC child to get a US passport, up to a certain age.

I never said the child wasn't a USC.  You made a bad assumption that the father must be a USC.
