We petitioned for my husband's mother, who is here illegally. Her Haitian passport has expired, and she doesn't have any other ID to bring with her to an interview. Does anybody know, can she use her expired passport? Or can she get a Florida ID without proper documentation of status?

K-1 Process:

12/04/15 - Engaged (L)

12/17/15 - K-1 submitted

12/31/15 - NOA1

02/09/16 - NOA2

03/16/16 - NVC case number assigned

03/17/16 - In transit to consulate

03/22/16 - "Ready" on CEAC tracker

04/14/16 - Received packet 3 by email

04/15/16 - Medical exam

04/28/16 - Interview - Approved!

05/25/16 - POE at Miami

07/08/16 - Married! (L)

08/09/16 - Filed for AOS

08/12/16 - Case received

It doesn't look like Florida allows undocumented individuals to get an identification card, although I am not surprised. https://www.leetc.com/driver-licenses/document-requirements

Packet 3 Sent : 11/10/13.. Had to schedule interview appointment and attach confirmation receipt to packet

Interview Date : 12/1/14                           Interview Result : Approved !

Visa Received : 12/10/14 picked up at Jacmel location

US Entry : 12/15/14 Fort Lauderdale, Florida

Apply for Social Security Card: 12/30/14 Connecticut

Marriage: 1/26/15

Biometrics: Dated: 8/25/17   Received 9/2/17   Appointment 9/11/17 

Approved: 10/23/18 -no interview

Are you trying to adjust status?  Your MIL had to have arrived to the US legally first.  If her I-94 expired while waiting for AOS then that is ok.  Actually, it would be ok even if she overstayed when initially filing for I-130 and AOS as an immediate relative of a USC.

Presumably the Mother entered with inspection.

Yes, she entered legally and over stayed. So everything is expired. Applied for I-130 and I-485 together.

K-1 Process:
