TOURIST VISA FOR MY IN LAWS

Hello!

I want to invited my mother in law and my brother in law to California, They live in Spain but there not spanish citizen just residents, I don't know what to do , where to file and which documents I need, my husband only has his green card, he just stared working since january, so I will be using my income taxes to file.   I'm a  US citizen

You want them to come over on a tourist visa?  There is nothing for you to do - no sponsorship or invitation required.

 

They apply on their own, and an approval would be based on their strong ties to home.

People who want to visit the US can apply for visitor visas.  Your in-laws can visit the US Embassy's website to apply.  All applicants are legally presumed to want to immigrate to the US and must overcome this presumption by showing strong ties to their home country to show their reasons for returning home after a visit to the US. 

You are not a part of the visitor visa process.  No one can sponsor a visitor visa.  Your tax return is not considered.  There is nothing for you to file.  None of your documents are needed.

For a tourist visa?  No.  A tourist visa is for visiting.  If they are approved, they won't be living here, right?  So why would they need sponsorship?

Not for a tourist visa. There is no sponsorship for a US tourist visa. It is a huge myth that many foreigners think is true. Your MIL and brother apply on their own.

As others have already stated no invitation letter or affidavit of support is required. They have to apply on their own and qualify on the basis of the their residence and ties abroad.

"Note: Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a visitor visa. If you choose to bring a letter of invitation or Affidavit of Support to your interview, please remember it is not one of the factors used in determining whether to issue or deny the visa."

When the little grand niece who is 9 went US Consulate in Rio she had an invitation letter I prepared at her mothers insistence(grandniece was traveling with grandparents not mother). I told niece this was a waste of time. Sure enough at the interview they refused to even look at it. This was for a nine year old. One grandparent all ready had a visa and his wife is a Portuguese citizen traveling on a VWP.

 

So dont waste any effort on an invitation.

Writing an invitation letter and showing that you can afford to host the visitor is not a waste of time since it is an option that is available.

It is a waste of time, based on what the Department of State itself says -- "A letter of invitation or Affidavit of Support is not needed to apply for a visitor visa. If you choose to bring a letter of invitation or Affidavit of Support to your interview, please remember it is not one of the factors used in determining whether to issue or deny the visa."
