Hi everyone,

I am kind of panicking about this I-134. I have read in lots of threads here that my fiance (The petitioner) needs to have earnt above 125% of the poverty line.

How much would that be exactly?

He has earnt (roughly) in the last year $22,000, maybe slightly more and has all his tax forms etc to show that... Will we need a co-sponsor? His Mum has said that she will do it if need be, but i'm wondering if we should send in all the co-sponsor forms anyway just to make sure?

Many thanks :)

The 2007 US Federal Poverty Line, as defined by the Department of Health and Human Services, can be found at http://aspe.hhs.gov/poverty/07poverty.shtml. The amount he has to have will depend on the size of his household.

Before you can figure out if your yearly income of 22K is enough, you need the number of people in the petitioner's household. Strictly speaking, for the I-134 it is not 125%, but 100% of the DHHS's poverty guideline amounts, that is to be considered. That said, some consulates expect 125% because the more detailed affidavit of support that you will file when Adjusting Status will require 125%, not 100%.

The DHHS's poverty guidline figures are here. The figures shown are at 100%, but you can easily do the math for 125%, if that is what your consulate is asking for.

Good luck!

toshtishtash,

See form I-864P for the poverty level guideline.

Insufficient information to hazard a guess as to whether or not some other sponsor will be required.

Hi,

Thanks very much.

Sorry, I didn't give very much information did I!?

It is just for me and him, there are no other people involved. Although he does pay child support at the moment... It comes to an end next month. (The children do not live with him)

Ok, so am I reading this right?

For 2 people in the household (Meaning him and me) he would have needed to earn $13,690 in the last year?

Yes if your consulate wants only to see 100% of the poverty guidelines. They may want 125%, that would be in your packet 3 checklist, I think....or perhaps another VJ member from UK can help you out there. But at 100%, yes $13,690 would be needed for 2 people.
