On the I-130 form it asks which embassy the beneficiary will be applying to. My spouse is a UK national but currently lives in Japan. However, her employment contract will end in August of next year and she will return to the UK. Does it make more sense to apply to the Tokyo embassy or the London embassy?

 

Since the CR-1 usually takes more than a year, London seems like the logical option. But would it be better to apply for Tokyo on the off chance the process is faster and then transfer the case if we need to?

so,  which embassy do you want for the interview ?

you still do not apply there for this petition

after USCIS and NVC do the 2 steps ,  the bene will fill out the ds 260 (which is the actual visa application)

read carefully the instructions from USCIS   and /or the guides above 

and always read the  I 130 instructions and those of other forms you will eventually need to do 

the above guides are put out to help you step by step

If she will leave Japan soon and will no longer have legal resident status there, select London.

 

Regardless of which embassy you select on the I-130, NVC will normally forward the case to the consulate that has jurisdiction over the beneficiary's physical address listed in the form.  I recommend that you keep an eye out for this at NVC stage after the petition has been approved.  If the case number you receive from NVC starts with "TKY", notify NVC immediately to route the case to London instead, as you indicated in the I-130.

You still need to make a selection on the I-130 form.  NVC may actually assign the case to that embassy.  So pick the embassy at the country where your wife is more likely to be in 6 months or so.

 

If your wife loses her resident status in Japan, I don't know if Tokyo will let her interview there.  You'll have to confirm that directly with the embassy if you and your wife decide that it would be better to apply in Tokyo.

She will definitely be in Japan for another 12 months. I guess Tokyo is the best choice for now? It just seems like a very grey area since the interview is likely to happen around a year from now and that's exactly when she would be leaving.

Yes, select Tokyo in that case.  1 year or less from petition filing to interview is more likely in Tokyo than London.  Hopefully, the Olympics won't wreak havoc on Tokyo's COVID numbers enough to cause the embassy to suspend operations.

 

[Edit]  Just realized that I misread your earlier post and thought your wife would be leaving Japan next month...

Timeline

They will assign based on her residence, they ignore whatever you put for your consulate selection.   Be prepared for an initial Tokyo assignment and if you want it changed you will intercept it at NVC.
