Hello, so I'm trying to fill out the I-864a form and I don't know how to do this. I'm sponsoring my mom's brother to come to America from the Philippines. On the i-864a, I had my wife filled it out and will provide my tax return. But for my dad, and my brother who lives with them, how do they fill it out? Because they're not my household members as they don't live with me. for the sponsor section of the form, am I suppose to fill that out? And my dad didn't make any income for the previous 3 years. How am I suppose to put that on the form?

Is your mom the petitioner?

Why are you filling i864A and not i864?

Why do you need to put your dad's info?

So I read through the instructions and I think  my wife has to fill out the I-864a as she's a household member, correct?

 

Also, does my mom have to fill out the I-864? She's the petitioner. I also see that it has "sponsor's" information as well. She isn't the sponsor, I am. she's just petitioning. So doe she fill out the I-864 including sponsor information about herself? She also doesn't work.

Your mom is the sponsor and so fills out an i864.

You are the joint sponsor and will fill out i864. If you filed tax return jointly and are using your wife's income as well, you wife should fill out i864A. If not using your wife's income, i864A isn't required but some embassies want it from the spouse regardless.

 

Your father and brothers have no role.

From page 13 of the I-864 instructions -- https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf

 

"NOTE: Even if one or more Form I-864s are submitted for an intending immigrant, the petitioning sponsor remains legally accountable for the financial support of the sponsored immigrant along with the joint sponsors. The petitioning sponsor must complete and submit a signed Form I-864 for the intending immigrant even if a joint sponsor will be used. The petitioning sponsor must also provide his or her Federal income tax return for the most recent tax year with supporting tax documents unless otherwise not required to file a Federal income tax return for the most recent tax year."

So, here's the problem: she hasn't worked in the USA at all since arriving in the 1980's(my dad was in the airforce), and my dad has been unemployed for 3 years but has money from savings. So how should she fill out that portion of the I-864?

Enter her current income as $0.  That's it.

 

You, as the joint sponsor, will need to meet the minimum income/asset requirement.  But your mom still needs to sign and submit the I-864 as the petitioning sponsor.  If she and your dad filed taxes MFJ for 2020, she must also submit her tax paperwork.  If she did not file taxes because she was not required due to having no income, she must submit a letter stating such.
