SSN denied because of incorrect entry date in DHS database

Hi everyone

 

Wondering if anyone had the same issue or could help with any information.

 

I entered US on a K1 visa in May 2021.

I applied for SSN in a couple weeks after my arrival. And 4 weeks later we find out that I was denied SSN. As per SSA, the reason is that they were not able to verify my info with the immigration (DHS) because as per DHS database my entry date is AUGUST 2021.

My I94 is correct (entry date is May 2021). So our guess is that someone at DHS made a mistake and typed the Admit Until Date (August 2021) instead of Entry Date (May 2021) somewhere in their internal system that SSA uses to verify immigration info.

Now the problem is that we are already married. And the SSA told us that because we are now married, we will not able to apply for SSN again even after the date gets fixed on DHS side.

 

Please let me know if anyone had the same problem.

Apply again when fixed. Use her maiden name that matches the one on the K-1 visa and I-94.  K-1 is a legal alien allowed to work > https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530

A K-1 entrant is eligible for an SSN with a valid stamped K-1 visa in their passport and unexpired I-94. It makes no difference if you are married or not. The legal alien entry status is the same,  a K-1 visa entrant/holder, and that is the status that will be listed when applying for AOS. Marriage does not change your immigration status. Being approved for permanent residency after filing for AOS is what will change the status. 

 

After applying for AOS in her married name, return to the SSA later with her EAD/AP or green card in married name and have the SSN updated to her married name.

 

You can try to get it in the married name, but it is advised to apply in maiden name(even if already married), as it can be a hassle when applying in married name. Some SSA workers will allow you to change it with the marriage certificate, as they should, but others will tell you that you need your EAD/AP in your new married name first(and as you can see, some will act like marriage can change your immigration status). They want the official government ID to show the married name. SSA workers are quite inconsistent in what they do and ask for, mainly because a lot of them do not know their own requirements and procedures for the SSN.

CBP deferred inspection to fix this issue (call or appointment) and if you’re still within validity period ask for SSN again.

it's so frustrating, we don't even know where the mistake is.

CBP deferred inspection confirmed all is correct on their side (and it makes sense since I94 is correct).

Our guess is that there was a manual mistake somewhere in the files SSA received when they did the manual paper verification request from immigration. SSA did this manual request since they were not able to access the SAVE system at the time when we were applying for SSN. It's just ridiculous...

Try another office if they allow walk ins, may be by this time they could verify thru SAVE. Try to apply under the maiden name. If no success, wait for EAD or GC.
