Timeline

Hello everyone,

I am a US citizen and On December 2020, I sent an I-129F application in order to bring my fiancé to the states. On March 2021 we got married. Is it possible to amend that I-129F petition to a I-130 petition since USCIS still didn't open the case yet?

 

Any advice will be very appreciated.

No amendment.  You must start from the beginning with a spousal visa.  See the guides.

April 29, 2013 - NOA1 for petition received

September 10, 2013 Interview - decision could not be made.

April 15, 2014 APPROVED. Wait for oath ceremony

Waited...

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen

The I-129f is now voided.  You have to start from scratch.  Here is a guide to help:

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Nope.

 

You have to start all over with a spousal visa. New petition, new fees, new timeline.
