Hi, 

 

We submitted our documents to the NVC on 2 June 2021. We received two notifications called "FE Review note" on 2 July 2021. They stated the below.

 

We had not submitted the sponsors (petitioner) W2's, as they had been working overseas previously and did not have them. We submitted 1040 forms for the previous three tax years instead (declaring foreign income). We called NVC who advised us to upload an explanation as to why we do not have W2 for 2020 in the W2 section of the upload. 

 

However, the second FE Review note we received is confusing and NVC would not clarify what it meant. The sponsor is now in the US and his income is well above the required income requirement. We provided his last 3 paystubs, employment contract, verification of employment letter signed and dated recently. We also provided evidence of stable income overseas for the previous three years in the form of employment contract and paystubs and 1040's. We are confused why they would recommend a joint sponsor when the sponsor meets the income requirements on their own. Has anyone had the same issue or can advise? 

 

Also, will we get placed to the back of the queue because we have submitted the W2 explanation letter?

This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. Please submit every 2020 W-2/1099 form for SPONSOR
