NVC Administrative Review: Lagos Consulate

Hello-

So yes I know that Administrative Review is typically a black hole where visa requests go to die. In any case, my husband had his interview on January 5th,2021. He was asked for additional picture ID from 10-15 years prior. My husband had his previously issued Passport with him at the time of the interview. However, it was issued 9 years prior and they would not accept it. He was provided a 221(g) form and all of the requested items were provided on January 6th, 2021 to the appropriate drop off center. Since then the case status updates have varied in time frame with the same message of Refused. The first was on Feb. 5th, the second on Feb. 12th, the third update on Mar. 11, and recently again on July 2nd. We have already submitted two inquiries with the Congressional Rep (In April of 2021) where they were told that the case is still under Administrative Review. The most recent request we submitted was done on June 27th,2021… which leads me to believe it was the only reason the CEAC website updated the status to July 2nd. 

 

I have two questions at this point:

 

1. Why do they need photo ID from 10-15 years prior? (My husband is not that old…we were only able to provide his WAEC Card and some student IDs from His Uni ). 
 

2. Would it be considered okay for us to go ahead and file the Mandamus lawsuit?  (We don’t want to be stuck in Administrative Review for two to five years like we have been seeing).

why would they want an old photo?

guessing his name is same or similar to someone else/  that is just a guess

 

and for Mandamus   ? up to u

all it does is force the embassy to make a decision and they can say denied

A writ of Mandamus will force DOS to make a decision instantly. If at this point the background checks are not finished the decision will most likely be a negative one. Do it if you want too but five months is really not that long of a wait.

So,

 

What waiting time would then be considered reasonable for these background checks to be completed?

So, I mean we can wait 5+ more months for them to still say denied correct? Do you believe that is the status it’s going to be given what they requested and how long it has taken for them to review it?

really don't believe any thing 

I have no idea 

about the photo -just a guess as it seems a strange request

 

and it takes all the faith you can muster to get a visa approval from any of our African countries 

don't give up 

things happen in God's time -not ours

I do understand that. Nothing is instant with this immigration process.  I guess my concern is another 5 months to 2 years Vs. 60 days… is all.

No he has not. When had been dating for one year after I visited him the first time he applied for a visitors visa (with me offering a sponsorship letter etc) but was denied the visitors visa. 
 

Other places he has travelled to: Dubai, South Africa, Kenya and Ghana (for vacations) all of which we disclosed and provided copies of visa approvals and stamps. Also, these vacations were all well before he and I knew one another and well before we filed.

Curious situation.  

 

On his B2 visa application, did he write that he was married?

Hello- 

 

He put down that he was single. He and I have both been married prior to now though. We both had proof of our divorce papers.

Hmm.......    From what you've said, I can't think of a good reason for their request for an old photo.   Haven't seen that before.  Please keep us updated on your case, and best of luck.
