I answered the question in my first post.  In that section, You can indicate that you qualify for AP based your I-485.  Here is a source:  I would include a copy of the I485 receipt.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you and I understand that, but I'm trying to figure out this part in part 7

 

Where it says : 

On a separate sheet of paper, explain how you qualify for an Advance Parole Document, and what circumstances warrant issuance of advance parole. Include copies of any documents you wish considered. (See instructions.) 

 

Do I need to explain how I qualify for an Advance Parole Document? And if I Do how do I address it on a separate piece of paper , is there a specific format ?

@Jill Mackie Happy Saturday! I just wanted to reassure you that your concern is valid but really, it comes from not being familiar with the process. And that’s OK.

 

You should not be worried about CBP denying you entry to the US. I know it seems too good to be true but in this case, it is. 
You married a US citizen, and after filing for AOS,  your visa overstay is forgiven. If that is your worst and only crime, that’s gone. Just like that.

 

The I-131 form is a bit confusing because it serves many purposes. You use it to apply for emergency advance parole, humanitarian parole, refugees and stateless people use it as a “passport” if they can’t get one from their country of origin; lastly, green card holders use it apply for re-entry permits if they plan on being outside the US for longer than 1 year but less than 2 years.

 

You want to submit it. It’s free. I should also explain that USCIS runs extensive background checks before approving the I-765 and I-131. So really, once they approve it, you can be rest assured that you won’t have any issues re-entering the US if you decide to leave the US.

if you apply for both the EAD and I-765, you will get a combo card. It serves as proof of employment authorization and allows you to te-enter the US.

 

sometimes people even fear traveling without their US citizen spouse, but again, there is no issue. My husband went to Malaysia by himself and had no issues. Sure, the CBP agent will take  you to a secondary inspection room and ask you a few questions - your husband’s name, yours, will confirm that you’re still married, done. 
 

sometimes people spend a long time in that secondary inspection room because CBP is running behind but as scary as it sounds everyone gets through it just fine.

 

I would just apply for both the I-765 and I-131. (And on the I-485 request USCIS to notify the Social security administration to issue you a SS card as soon as you’re eligible - actually, the check box may be in the I-485 or I-765, I forget now).

OMG! Thank you for actually taking the time to explain it to me , this all very confusing to me , I'm not exactly well versed on immigration and my husband even less so and as I already mentioned in prison , I honestly cannot thank you enough for showing me such kindness and explainimg it step by step . What I am confused about is part 7 having to write on a separate piece of paper why I should be granted advanced parole. Am I supposed to explain it on paper and if so is there a specific format ? Thank you being a kind understanding and helpful soul , not many people are .

You qualify because you are applying for adjustment of status. If you want to add a separate page to state that, that's fine. I didn't, and I was approved without it. 

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.

No worries! I reassure you everyone is trying to help you. Sometimes tone gets lost over the written word. This is also a very emotional time for you. After years of worrying about your status, All of a sudden we are all telling you that once they approve your combo card, you can go home and see your family. It sounds  too good to be true but it is actually true! 
part 7. You do not need to answer that. Simply check the box that says “more than one trip”. Enter N/A for all other fields in part 7.

Thank you for being a calming voice , yes, it is an extremely emotional issue for me , but I understand I made my own choices and take responsibility for them. I guess, I just want everything to be perfect ,because I have an incarcerated husband I know they will scrutinize me more. I just want it done correctly rather than mistakes . I do appreciate the help from everyone. Thank you again for being patient with a dumb blonde 🤪

For the Part 7 that you keep on talking about, you don't need to explain anything. Leave it blank. I helped my friends file theirs', provided no explanation and still they got the AP. 

 

With COVID, I'd suggest getting AP too. It is free too. AOS timeframe has increased. You never know when you'll need a quick trip outside US. 

 

And I last went out 2 years ago on 2 year's GC and came back, no issues. In a month's time, I may or may not use the GC anymore, depending on how my N400 interview goes and if I manage to squeeze myself into an oath ceremony shortly afterwards. So as @Lucky Cat said, only USC are guaranteed entry. However, they're a lot of GC holders who fly in and out, with no problem at all. 

 

Breathe. Take it easy. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

part 3. You do not have to enter a date of intended departure. 
answer no to the question about exclusion, deportation, removal proceedings.

question 5. Select that you want the travel document to be sent to the address shown in part 1.

Enter N/A for the rest of part 3.

I dug up my husband’s I-131 submission and we submitted 2 passport style photos, copy of passport identity page , copy of his visa, and copy of his I-94.
