Hello again 

 

I'm submitting my AOS on Wednesday , I just have a question regarding Form i-131 the application for travel document. What is the purpose of the document , I'm not planning to return home at any time yet ,since the instructions say it's not a guarantee I'll be allowed back in and since I overstayed my visa , I'm sure there's a chance they won't let me back in and especially if I come across some officer who's having a bad day. If I decide to apply for the documents, do I need to complete Part 7 ? Where it says

 

On a separate sheet of paper, explain how you qualify for an Advance Parole Document, and what circumstances warrant issuance of advance parole. Include copies of any documents you wish considered. (See instructions.)

The entire purpose of the I-131 is to allow you to re-enter the US.  Many members here have failed to submit an I-131, then regretted it later.  It would be very foolish to avoid submitting it since it costs nothing.  Your fears are unfounded.  You qualify by applying for adjustment of status.  You don't have to list specific dates or reasons.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Can you find any such cases here on VJ?  I can't.  

I'm not saying there's a case on VJ , I'm saying as I overstayed my visa there maybe a chance they won't let me back in. Also there was a case in Utah recently where a woman with a valid green card was denied entry because the officer thought she was lying . Not saying it will happen but there is a chance.

Why would they deny entry if you have approved AP?  That is the entire purpose of an I-131.  There are thousands of people who use AP every year.  I have not seen any cases where the holders were denied entry.  What I have seen is people who had to unexpectedly leave the US WITHOUT approved AP, then were stranded outside the country.

Because on page 1 of the instructions it says the following , maybe I am misunderstanding something but I took it as not a guarantee.

 

WARNING: The document does not entitle you to be paroled into the United States; a separate discretionary decision on a request for parole will be made when you arrive at a port-of-entry upon your return

No one except US citizens are guaranteed entry.

It's states she had been living in Utah and working legally . You seem to be looking just to argue . It's a legitimate concern to me which is Why I asked in the first place.

Exactly my point !!!! 

I am merely stating that numerous members here have failed to submit the FREE I-131, then later regretted it.  I am merely stating that the chances of you being denied entry with approved AP are EXTREMELY, EXTREMELY low.    I am merely stating that the woman in the article did NOT have a valid Green Card (as you stated) or approved AP.  You can make your own choices.

In any case, like it has been mentioned, you might as well apply for it, since it is free. You never know if an emergency back home might happen, and it's better to have it and not use it than to need it and not have it.

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.
