I-130F Unsure of this whole process

Hello,

Me and my husband, have been married for 6 months now in the UK. He's British and I'm American. At present we are living in the UK and filed the I-130f so we can move back to the states. They recieved my form on May 16 and it's now July 5. I'm not sure how long it takes for the next step, I'm not even sure what the next step is. Should I be worried, and when should I honestly expect that he will have the visa to enter the states. WE have a pretty straightforward case, but I still feel worried as in processing times and doing things accurately.

Any advice, help, insight would be greatly appreciated!

I assume I-130 as there is no I-130f.... best thing to do is read the guides to give you an idea of next steps... Hearing nothing at day 50 is not unusual... How do yo uknow they received your form? Did you receive you notice of action assigning you a case number? if you paid your fees with a personal check, has it cleared the bank yet?

well its been a crazy weird situation. i sent the forms to vermont bc my permanent address is Rhode Island. Then I recieved blank I-130 forms bank in Rhode Island with no receipt number nothing! So I called and they couldn't figure it out at first, and then when I spoke to someone she had asked if i applied in CA which I didn't so she said she found this receipt number and told me 6 times that I had no case. So then when I put the recceipt number in online it said that my case was just recieved in CA. So long story short, I guess it was sent there, and it's taken me until yesterday to speak with the bank and realize that the check is cleared. So they recieved it May 16. I'm very paranoid about this because I just want it to work out, and they are very UNHELPFUL when you call them on the phone.

I'm no expert (and I certainly don't want to confuse you further), but since you are currently living in the UK, you seem to be eligible for direct consular filing (DCF) with the USCIS office at the US Consulate in the UK, which should be (much) faster than going though USCIS back in the States. Perhaps you may want to call the US Consulate in London and ask what your options are.

Good luck.

My wife's USCIS journey:

I-130 (IR1) Timeline

03-26-07 -- I-130 sent to VSC

09-20-07 -- Permanent Resident

N-400 Timeline

09-20-10 -- N-400 sent to Dallas lockbox

09-24-10 -- Check cashed

09-27-10 -- NOA received

10-07-10 -- Biometrics letter rec'd (appointment for 10/19/2010)

10-15-10 -- Biometrics done (walk-in at Alexandria, VA facility)

10-23-10 -- Another Biometrics letter rec'd (1st fingerprint set unusable according to FBI; appointment for 11/19/2010)

10-25-10 -- 2nd Biometrics done (walk-in at Alexandria, VA facility)

10-26-10 -- Called FBI: Second fingerprint set okay

11-20-10 -- Yellow letter received

01-26-11 -- Interview letter received

03-01-11 -- Interview (Civics test passed, but "Decision cannot yet be made" -- Docs missing)

03-25-11 -- Oath letter received

04-18-11 -- Oath Ceremony -- USC

I tried filing in the UK, and since I've only had my visa to stay in the UK for a month, they said I have to file in the USA. So that idea is out. Any further advice about this process?

Ok, your not doing so bad. Lots of cases were sent from Vermont to California in April and May as VSC was deluged. So your in plenty of company. Also, there was a huge slow down in receipting cases in April and May, so a receipt date of May 16 for having sent from UK on april 30 is not bad either. There was a Cali computer glitch that resulted in severe delays of sending receipts (and some never got one at all yet). So like I said plenty of company.

You might want to adjust your timeline from "other visa" to "CR-1/IR-1" on this site. It will then give you a projected adjudication date based on the average processing time of all CR-1/IR-1 I130 petitions that were entered on VJ. This will be another tool to give you an idea when you might expect approval from USCIS.

Cheers
