BROTHER TURNS 21 BEFORE GOT APPROVED.

Hi everyone, 

 

I am at lost here, I just need some clarification of the issue of my brother petition. My mother is a LPR and petitioned my brother under 21 at that time. The PD was October 25, 2019, it took them 20 months for him to get approved, he just got approved June 22, 2021. After receiving the approval letter the visa category change from children of LPR under 21 to unmarried children 21 older. I already got the NVC case number and all, and saw that my brother is at f24 visa category. What should we do? is this petition can be under CSPA? or my brother already age out? We can't pay IV fee because its not available yet. I don't know how long it will take. But please if you have any knowledge about this kind of issue, kindly response to my post. Thank you so much in Advance.

Manila keeps doing this to IR2 and F2A… you are correct he is protected under CSPA. Maybe search the forums for similar posts to see how they resolved it, but start by calling the embassy.

The case is still at NVC. Your mother or your brother can call/email NVC and remind them of CSPA age. They should put it back to F2A and let the process start since it's current.

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
