What would be the rationale for an expedite?  I haven't heard of that before.  People can expedite EAD with a formal job offer, but I haven't seen an actual AOS expedite.

I’ll be at a severe loss of money. I am currently on maternity leave with my job and with Covid happening everything stopped right. We’ll also in the middle of Covid my k1 was approved. Anyway here in the US now and have to adjustment my status but I need to go back to work in February for 6 months. If I don’t, I have  to pay back all the money ( top ups and benefits) my worked paid me back in full

Then as previously mentioned,  you would expedite the Employment Authorization

So you've already been working in the US?  And you have an EAD?

@Freckles21 USCIS has granted requests to expedite AOS under extremely special circumstances. I know of two cases. One was a high school student who got admitted to college and needed to be a legal permanent resident to accept thousands of dollars in scholarship money. They reached out to a US Senator/maybe Congressperson and just like that, within week of filing for AOS he got his green card. Another one was a researcher who needed to be a legal permanent resident in order to accept a federal grant. I do not know of any successful requests to expedite marriage based AOS petitions. 

 

In your case, you do not need a green card to do what you intend to do. You just need the I-131 Advance Parole, but you may request to expedite both the I-765 and I-131. That way you will get a combo card. Right now the processing times for the EAD is 7.5 to 10 months. 

 

Are you able to do your work remotely? That's another option.

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

I am just afraid that with the Advance Parole, theres a chance they may not let people back into the US from what I've heard. 

 

No I can't work remotely, I work in a Hospital.

I do not know of anyone who's had issues re-entering the US with Advance Parole. You can search through VJ. It's pretty standard to use Advance Parole.

I think you are OK to be outside of the US for less than 1 year. *I think* You could always re-enter several times.

I’m only going to be away for 6 months. Oh I see okay thank you for the information. I’ll definitely look into it. So should I send my AOS stuff first than expedite it or can I send a cover letter with my evidence along with my AOS
