Had a new baby, +1 to household. Does NVC need baby's birth certificate?

Timeline

When I first petitioned for my wife, it was just us 2. But we just had a new baby a few months ago. 

 

When we apply for her visa (NVC) and I fill in my I-864, we will have a household of 3 members. Do we need to submit our baby's birth certificate + translation to the NVC

 

We don't have the translated version and probably won't be able to get one anytime soon due to the lockdown, so if we are required to provide a birth certificate, could I just write a letter explaining that we're locked down and can't get it translated at this time? I could also send in the CRBA and a photocopy of my baby's passport as well. 

 

Thoughts?

Your baby is not a visa applicant, so no need to upload the baby's birth certificate or any other civil documents to NVC.

 

Do bring the baby's BC or CRBA to the visa interview as additional evidence of bona fide marriage, although the consul officer would likely know about the baby already from your wife's DS-260.

11 Dec 2020: I-130 approved

 

NVC

17 Dec 2020: NVC Received

25 Jan 2021: Paid AOS and IV fees

14 Apr 2021: Submitted I-864, I-864A and DS-260

14 Apr 2021: Expedite request

04 May 2021: Expedite approved, case sent to Consulate in Naples, Italy

 

US Consulate Naples, Italy

04 May 2021: Consulate received

18 May 2021: Requested expedited interview

20 May 2021: Expedited interview approved and scheduled for 8th June

07 Jun 2021: Medical at Istituto Varelli (Naples, Italy) - Very friendly staff, spoke English

08 Jun 2021: Interview - APPROVED

09 Jun 2021: Picked up passport with Visa in person from Consulate 

 

USA

17 June 2021: Entered New York (JFK) as Point of Entry

17 June 2021: Landed in Arizona and reunited with my wife :) 

28 June 2021: Received Social Security Number

10 July 2021: Form I-551 (Green Card) marked as in production

15 July 2021: Form I-551 (Green Card) received in the post

Regarding OP's scenario and the DS-260: If the U.S. spouse and new baby (U.S. citizen based on CRBA) are living abroad with me, do I answer "no" when asked if they are immigrating with me? They are, of course, going to move with me, but are USC, so they technically don't immigrate, right? As always: Many thanks for your time and advice in advance!

Yes, the answer should be "no" for both.  USCs do not immigrate to the US.  They'll just relocate.

 

The DS-260 is a generic form for IV applications, and that question is intended for those applicants with derivative beneficiaries.

Whoa, thanks for that - I had my wife answer “yes” to that question on the DS-260. We’ll change it to “no”. Good catch!
