Those sound like documents more appropriate for the AOS interview rather than required for submission.  Maybe others can weigh in, but I remember when we filed for my wife's AOS, we only submitted the marriage certificate and we took evidence of ongoing relationship to the interview.

As long as the I-485 is submitted before the I-130 is approved it's considered concurrent filing and the receipt numbers will begin with  IOE.

Proof of visiting your husband seems more like evidence you submit with the I-130 which you already submitted. I would say you can just bring that to the interview. 

The I-485 is more about you not being inadmissible and being eligible to adjust status.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

We were were told by an attorney because the prison shut down vistis for a year and allowed video visitis we needed to get those documents too. The prison only gave us in person documents .

Advise your attorney of the possibility of ICE getting involved.  Your attorney might give you modified advice.  
 

Is the prison open now? Have you visited your husband recently? Do you have evidence?

Yes the prison is open but limited to 1 visit a month , I have had my visit this month and had to schedule the visit online and the prison visiting office sent confirmation for that visit which I have.

I understand. All I am saying is that those documents belong with the I-130 Petition of alien relative. The I-130 requires all the evidence of bona fide marriage. And you already sent that. 

If that is what your attorney advised, well then I would concur with @Mike E here, you may want to mention your neighbor's threat to your attorney. 

 

I think that we are all just trying to establish whether filing the I-485 without those documents would cause USCIS to reject your petition. And from what I am gathering, it wouldn't.

I would file that I-485 today.  This will blunt whatever ICE might do.

I agree, I don't see these documents as leading to a package rejection.

Okay well that is great to know , I can submit sooner , the attorney was just concerned or maybe overly cautious with there being a year of no visiting because of Covid .

If that is a concern at any point, you would get an RFE (Request for Evidence) but coming from the I-130 side (Petition for Alien Relative) and not from the I-485 side.

Ok perfect , we submitted 8 years of evidence with our I -130. I have a question , is it then necassary to submit further evidence with the I-485 other than what they require? If I can get this sent off in a day or two I'd rather do it
