My best recommendation to you is to include evidence since the date of the marriage. There will be overlap between what you submitted for AOS and what you are submitting now. That is fine. The officer is at a service center and your AOS file is at the field office. They do not have it and you do not want to get an RFE. They do issue them from time to time. 

 

Bank statement, credit card statements - all of that, they want to see each and every month since the date of the marriage. (Some people do a selection and get approved. Some people do a selection and get an RFE or get called for interview. We sent everything).

 

Joint taxes - I would go to the IRS website and request IRS transcripts. You will save a ton of paper there. 

 

I would include the lease you sent for AOS. Last but not least, submit all pages of a statement. Do not skip blank pages or any pages. 

 

You have really good evidence. You will be fine. :) 

 

Thanks very much. Even though I feel like I have provided an orgy of evidence, it does seem deficient with regards to "statements each and every month since the date of marriage." I only included two brokerage statements, two credit card statements,  4 cell phone bills,  and two cable bills, spaced several months apart. That seemed sufficient - if you have a joint cell phone bill in January 2020, Dec 2020, and May 2021, I it's highly unlikely the absence of the months in between will indicate anything). The statements I include generally only start late 2019 (we married in late 2017) because that's how far the bank, Verizon, cable allows me to go back for the bills.  Having said all that, I will try and pull our lease renewal for each year for the past 4 years to further support it and then also one more tax year (2018). I feel good about that, especially with the extensive pictures. Thanks again!

@USC4SPOUSE Do you know how long from submission it takes to get the notice that extends the green card expiration? Also, does everyone who applies for removal of conditions have to interview (like AOS) or just a select few who they are on the fence about?

You're welcome, @KeratNY And it comes down to what you are comfortable with. We included every statement of the joint account since the date of the marriage because that account predated my marriage. Our brokerage account is from 2020. So we included what we had. I believe it was in 2019 that folks were getting these RFEs asking for every single piece of evidence since the date of the marriage. I have not seen those happen lately. 

 

You are correct - banks, Verizon and everyone usually only let you access up to 16 months. Knowing that planned and kept printing items as time went by. We also had a clone of our AOS submission and of the evidence we brought to the interview. Selected the most solid evidence and built the package from there. 

 

We did not include cell phone statements or records. Did not think that was necessary and again, we had to ship it because my spouse's green card was due to expire on the day the package arrived in Phoenix. 

 

Another good one is the US citizen's voter registration. You can easily add that to show evidence of living at the same address. 

 

If you got married in 2018, then absolutely, I would include that tax year. 

 

We did not include include that many pictures. Maybe 10 or 15? They're not considered solid evidence but it does not hurt to include them. 

 

You're fine, though. You have plenty of evidence. :)

@KeratNY our package arrived on 05/07/2021 and we got the letter ~05/26. (We have a UPS PMB and only check it once a week or so). It did not take that long and it seems like 3 to 6 weeks is the standard. Keep in mind that your status as permanent resident does not expire even if you do not have the letter. You continue to be a permanent resident. If anyone were to run e-verify on you, you would still show as a permanent resident and authorized to work. 

 

Who gets an interview? You will get a better idea after going through these two links. https://citizenpath.com/avoiding-i-751-interview/ USCIS assign fraud levels and from each fraud level group they will interview some people. Thus, they will interview cases where there are no fraud concerns. 

 

Now since 12/10/2018, USCIS will interview everyone who they have not interviewed yet, and if they have interviewed you once already, and there are no fraud concerns and there is plenty of evidence of bona fide marriage, then the officer has discretion to waive the interview. https://www.uscis.gov/news/alerts/uscis-revises-interview-waiver-guidance-for-form-i-751  In a nutshell, if USCIS interviewed you for AOS, then the officer has discretion to waive your interview. If you entered on CR-1 visa, then they would interview you. 

 

Unsolicited advice:

  • Do not wait until the day before your green card expires. You will be able to use ground shipping or cheaper shipping. I would go with either Fedex or UPS. I have read about too many mishaps with USPS. 
  • Include the G-1145 form to get a text message notification. https://www.uscis.gov/g-1145

And please, once you get your NOA, make several color copies of it. Keep one in the car, keep one at home and put the original in your safe!

Will do! On the signatures, how many signatures are needed? And just on the I-751, right?

Yes! Just checked ours. Just 2.  Your US citizen spouse has to sign as well. :)

@USC4SPOUSE thank you. Do you know how long it takes from when they receive the packet to when they send out the text e-notification and cash the check/process the credit card payment? They received my package 2 business days ago and I haven't heard anything yet.

@KeratNY Posted my timeline below for you. It was pretty quick. We sent a check, though. I think 2 to 5 weeks is the standard. I believe people are seeing a bit of a faster turn around with credit card payments. As long as you get a text message with your case, you are fine - as that means they accepted your filing. Fingers crossed for you! :)
