Hi guys,

 

Please give me some advices on my case. I submitted the applications of I-130 for my parents on March 8, 2020; and only mom got approval for it in October 2020. However, till now my dad's case has been still processing; so I made a call to USCIS yesterday for investigating which center is handling my dad's case. Per a representative, she said that his case is handled at National Benefits Center (How weird!!!) I did some researches about some centers processing I-130 and realized that there are a few of centers (eg: California, Texas, Vermont, Chicago ... ) to process I-130 only. So, are there any you guys to have the same case as mine? Also, if National Benefits Center is reviewing I-130, how could I check the processing time of I-130 from that center at the present?

 

Please help and appreciated much.

Is your dad in the US?  If not, is there any chance that you indicated in the I-130 (part 4, item 61) that your dad will be adjusting status in the US?

No, my dad is in Vietnam. While filing, I stated very clearly about his domicile...He needs to pass I-130 for the next step of processing NVC as well as interviewing from US consulate in Vietnam

Call USCIS again to confirm where the I-130 petition really is.  If the I-130 was actually sent to NBC, that's a mistake because NBC handles cases of those already in the US adjusting status.  Reiterate to the USCIS agent that your dad is in Vietnam to pursue consular processing.

They said that my dad's case is currently processed at Missouri Service Center. However, I searched on the web of processing time and didnt find any center relating to Missouri ... Have you heard it before? How could I check my dad's case from that service?

That's the National Benefits Center in Missouri.  Log a request to have your petition for your dad re-routed to a service center that handles petitions intended for immigrant visa processing.

Thank you for your info...I will try one more time ( in fact, I always fail to get info from calls to USCIS)...Hope to get something from them.

In the last week, I called to the USCIS as your instruction; they said that: NBC processes I130 that should be normal and nothing is wrong with my dad's application. If I would like to prefer a certain center for processing I130, I could write a letter to send to USCIS for requesting. Also, that officer also didnt help me to transfer to any supervisor or a Tier 2 officer for asking; she said that there is not necessary to do it because the case is under the processing time. I feel worried about it without finding any other way to resolve... In fact, my dad's application has been waiting for 501 days already without any action of moving.

NBC normally holds the I-130 forms of those going through adjustment of status, which your dad is not.  Not all USCIS agents are familiar with their own procedures so you need to keep trying until you can talk to someone who actually knows how to help you.  I suggest you call again and strongly emphasize that your dad will be applying for a visa through consular processing in Vietnam.

My case was transferred to the National Benefits Center from the Nebraska Service Center just as we went out of normal processing time.  The never told us, I only found out because I was trying to submit a request for a tier two call for going outside of normal processing time which kept getting denied...because they had transferred us to a center with a MUCH longer processing time.  I spoke to the customer service reps, tier two and they all said it was normal...which I think they were lying.  I watched people that applied months after me that already had their spouses in the US and nobody would tell me why our case was being transferred and taking so long.  USCIS seems to be about the most useless (and incompetent) government agency around.  They have about ZERO transparency!!!

Hi Jessica,

Could  you please let me know what happened with your case now? Is it still at National Benefits Center or they transferred it eventually? My case is exactly like yours and not sure if it’s normal to leave at the National Benefits Center or wait? My beneficiary lives overseas and needs to go through counseling process. Please advise!
