We were waiting for my wife's green card in the mail today.  We opened it and notice it's a 2 year conditional green card which is not what we expected.  We got married on May 13, 2019 and our green card issuance date is June 17, 2021.  Our marriage has been over 2 years since the issuance of the card, so we're expecting a 10 year green card.  We even confirmed with the IO during the I-485 interview, she said we would be getting the 10 year green card!

 

Currently waiting on the phone with USCIS, but what will likely happen and what will we do to fix it?

You will have to submit an I-90 to get the mistake corrected.....Yes, you will have to return the incorrect Green Card.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She will, likely, need evidence of her status as a legal resident to apply for work.  That evidence can be shown by a Green Card or an I-551 stamp in her passport.  I would make a copy of her green card prior to returning it, and I would make an appointment at a local USCIS office to get a stamp in the passport.

I just filed the I-90 online at https://www.uscis.gov/i-90 .  We'll see how it goes.  The online application didn't ask us to send in the original green card.  Only to scan the front/back of the green card and uploaded that.  I also provided a cover letter explaining the situation.

In the mean time, I would request an info pass appointment to request the I-551 stamp. I would not wait until you get the RFE to do it. 

I would also scan the green card (front and back) onto your PC. That way you have a digital copy of it. 

I would also update your Social security card. That way it will not show "valid only with DHS authorization". You will then be able to apply for jobs with your SS card and driver's license when the time comes. :) 

Congrats on your green card! You won't have to go through removal of conditions!

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Are they still taking info pass appointments?  I thought they temporarily stopped.  

 

I would like to get the SSN updated but don't they require us to send in the green card because of the pandemic?

You have to call USCIS to get an info pass appointment. They schedule them for reasons they deem necessary. Getting the I-551 stamp before you have to send the green card back is a good reason. 

 

You would have to check with your local SSA office and see what they are doing.

Call the SSA office and ask for express interview.  Non-citizens should not be required to send the originals of their immigration documents as that would be against DHS regulations.  Cite memo EM-21041 if the SSA agent is not aware of this policy --

At infopasses they sometimes take the greencard when you get an i-551 stamp. Not sure how that would work if they ask you to send it in later on, and you don't have it anymore. I doubt you get a receipt that it was already handed over. And as usual with USCIS, one hand doesn't know what the other one does, so it's not like the part of USCIS sending you an RFE for the card have been notified by the local field office that your greencard was already confiscated. 

Pretend you already sent your greencard, maybe? And just use the NOA1 for the infopass.

Yup, after a several year long immigration process I do NOT trust USCIS. 😝

Thought it was over when we receive the green card!

Since per your timeline your interview date was May 17, more than two years after you married you absolutely you have received a ten year green card.  
 

Whether you want to wait until she gets a job to file I-90 or not is up to you.  
 

I would instead first

 

* get the SS card without the DHS authorization needed annotation 

 

* a drivers license or state ID using the SS card abs green card.  
 

Then I would file i-90.  
 

This way her state ID/DL plus her SS card are all she needs to work for I-9 purposes.
