Questions about NVC's requirements [merged threads]

I'm about to submit both civil and AOS documents. Just had few questions.

 

A. I don not see DS-261 form anywhere. I see that on this page, it mentioned to fill out DS-261. Could anyone help me if this is required? 

 

B. I'm requesting NVC that my spouse will bring police report at the interview itself since she is not vaccinated yet and might take her a month or so to get the vaccine in Nepal. Has anyone done this before and actually NVC accepted it?

DS 261 was removed from the process by NVC  a while ago. The guides on here are not always updated .. recommend going by the official USCIS guides if there is a difference

IRS office has my spouse's original passport since I applied jointly with my wife and getting her ITIN number. My application was received on June 1, 2021. I have 2 questions if someone could help me.

 

A. How long normally IRS keeps the passport for processing ITIN number? It's been almost month now. 

B. I need a page 31 from the passport to make police report for my wife back in Nepal? If I call IRS, would they provide me copy of that. 

 

Any feedback would be appreciated.

As I'm trying to work on gathering documents for NVC, I see police report is required for Nepal. I'm having difficult time making police report since they require to have page 31 from passport of my country and currently my spouse's passport is with IRS to process ITIN number.

Questions: 

A. Has anyone tried to put an comment saying that they will bring passport at the interview itself and NVC is able to put in DQ. Do you think NVC will accept that? 

B. Would anyone advise just to wait until getting passport from IRS and then applying for police report in Nepal and then submitting to NVC

 

Sorry with multiple questions, just trying to get feedback from some experience team members.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

NVC will not complete case without Police report. If they are asking for police report, you should get them a police report.

It will be a while (may be few months) till IRS returns the passport. Your wife can't get the police report till then. Rather than waiting for IRS to return the passport, you can upload a letter explaining why she can't get the police report and that she will bring it to the interview. If NVC is ok with it, all good. If NVC says the police certificate will be needed regardless, you just upload the PC once your wife gets it. NVC will likely be done reviewing the documents before she gets the PC anyway, so no loss in time even if NVC says the PC will be required.

 

This is one thing I prefer filing Married Filing Separately rather than going thru ITIN process. No advantage anyway in terms of immigration process but there is always a risk of loss of time due to IRS processing and of passport getting lost in the mail.

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

Regarding getting the passport back from the IRS, as I recall some of their publications mention 6 weeks as a time frame for getting documents back, but it seems like everything is slower right now.

 

I started a thread in the Taxes & Finances subforum and the only person who reported getting an ITIN from earlier this year said it took 11 weeks.

 

I sent in my wife's state ID and am waiting on getting that back. It is now about 8 weeks since I sent everything in. I am expecting to have to wait at least another month.

I will try to call IRS and see if they can return passport meanwhile also try to explain to NVC. It's been 4 weeks since they got my ITIN application. 100% agree with you on filing jointly, made a mistake. I didn't think my wife application would approve within 3 months, so I kinda thought even if they take 3 months, I have time but USCIS had a different story to write.

Any updates? Were you able to get a hold of IRS? I’m in a very similar situation
