I864 Joint Sponsor question

Hi Seniors,

 

I will be filing for i864 with my wife who doesn't work and is unemployed and one of our friend who makes enough money to sponsor me.

i have below questions:

 

- do we need to say in our cover letter that what is our relationship with joint sponsor?

- we are adding i864 for joint sponsor, sponsor’s w2, transcripts and 1040 forms. Also including sponsor’s USC proof. Are we missing anything else?

How does your wife plan to support you during the 8-10 months you can't work?  The friend is going to do that, too?

You're adjusting status in the US, right?  And you realize that you will not be able to work until you have the EAD, which is currently taking upwards of 10 months?

 

What will the two of you live on during those 10 months?  I'm sure the USCIS officer would question whether some friend is actually going to support you and your wife for that period of time.

It is the totality of the circumstances.  With no work or job prospects, you risk being deemed likely of becoming a public charge.  Good luck.

That is assuming OP works after 8-10 months. He may just chill and not ever plan to work, just saying.

In general no but in very rare cases, some COs like to see such letter from the joint sponsor.

Got it okay. So we dont even mention joint sponsor is our friend in cover letter correct?

I don't think you do get it.

 

But a cover letter is irrelevant.  They will definitely ask about the relationship with the joint sponsor, especially since your wife has no income to sponsor you.

You may or may not mention, it doesn't matter. You will very likely be asked about who the joint sponsor is at the interview. Be prepared to answer in case the CO grills about it.

The IO might ask how your wife is supporting you right now.....Living in the US is very expensive.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

@HarryHerc, to answer the two questions you asked. 

1. do we need to say in our cover letter that what is our relationship with joint sponsor?

No, I believe the form asks asks that. You do not need to include that on your cover letter. Just make sure you fill out the form correctly. 

 

2. (...)Are we missing anything else?

It does not hurt to include 6 months of most recent paystubs. Definitely go through the instructions. The instructions are a separate document. It is tedious to read but definitely read it and see if you need anything else. 

 

In the mean, fingers crossed for your wife to find work in the mean time. Hopefully, by the time the interview comes you will already have your EAD/AP combo card and you will have a job, too.

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
