My husband will be applying to university.

 

His  green card has been pending since May 5 and is at the National Bens Center.

 

Is there any immigration law that does not allow him to be a full time student? 

 

We are in Texas

I think they will just want to verify that he is eligible to be in the USA with some form of documentation. At least, my school required that. I had to show my green card, but if his is pended right now, then anything else showing that he is allowed to study in the USA. I guess there are rules regarding studying in the US and being a non-citizen. Wishing him good luck!

There is no law that bars AOS applicants from being full-time students in the US.  But the university will want to see proof of residency and immigration status, as there is a Texas law that classifies university applicants based on residency, to determine which tuition rate to apply.

@ClaytonandKierraThe answer to your question will vary from state to state as well as from school to school. I think most schools will be OK with him presenting the I-797 showing that his AOS is pending. The question really is whether he will qualify to be classified as a resident for tuition purposes. Most schools will allow that if you are married to a resident of the state who can qualify as a resident for tuition purposes. For the most part, that means that the spouse has to have lived, and worked in that state for a year. Some schools may want to see driver's licenses, W-2 forms or even tax transcripts. Again, that will vary from school to school and it may take you perusing the registrar's office web page to find those answers.

The best way is to ask the school what they will need from him in order to study. Talk with an admissions specialist, and they'll let you know what they require.
