I am going to file my AOS application soon and I am concerned about my middle name in passport and other documents being not being present on my birth certificate. In my birth certificate, the name is listed as John Doe and my father's name is listed as Steve Doe. Now, it is customary in my home country to use father's name as the middle name in school etc. As a result, I have been using John Steve Doe in all my documents including Passport, US visa, SSN etc. Will the middle name not being present in the birth certificate be an issue in my i485? Also, is this something that I can explain in a letter sent with my application? Any help is appreciated.

Interesting. What name do you use on your SS card and US driver's license?

I use the name on my passport, i.e. John Steve Doe on my SS card and US driver's license. Even my school certificates back in home country have the name as John Steve Doe. This is due to the fact that father's first name was entered as the middle name.

OK. My concern for you is that USCIS might issue your green card in your birth certificate name. So if you later go to the state motor vehicle department to update your drivers license, your green card being your proof of authorized presence won't match your original DL.

 

But then again I believe Washington state won't give non-citizens REAL ID (REAL ID in Washington  is tied to Enhanced ID used as a land border crossing document)  so it might not matter.

At any rate, interesting. I doubt you are the first Indian with this issue, so will watch with interest what your country-folks.

Thanks for your response. It might be best to consult with an attorney as well because I don't know if having a name difference in passport and green card will cause issues in entry or not.

Yes it can. Generally this can be finessed with a legal change of name document.  The typical case is a woman who takes her spouse's surname. A marriage certificate is generally an acceptable change of name document for airlines when checking in such passengers.

US immigration will use the name in your passport so use that.  No issues.
