If this topic has been answered please point me there. I am filing an i130 together with an i485 for my spouse. 
 

in the instructions for the i485 it doesn’t ask for evidence like pictures and combined bills etc. do you only take that to the interview?

 

I had compiled a lot of evidence to include like pictures my travel before he came here etc to include but I don’t see a place where they are asking for that 

 

the i130 asks for proof but it’s specific to bills, support statements, a lease etc. nothing about pictures and other evidence I thought I could include like our therapy records, our joint medical stuff, our traditional wedding plans etc. 

 

I’m trying to be careful because my husband and I actually got a divorce, he came here on k1. We have withdrew that petition, reconciled and are now going this route. The first time we did the i485 I recall sending pictures. I’ve  heard a lot of times the officer doesn’t look at your evidence you bring to the interview but I want to do this the right way 

 

what did you send if you filed the i130 and i485 together? I’m Also including the i130 supplemental, affidavit of support, i765 and AP 

 

also both applications as for passport photos and a marriage certificate. So do I include those twice?

 

will we send one $1760 check for the 3 fees - ($535 + $1140 + $85) or the $535 is separate from the $1125 AOS fee?

It shows you did something together/ as a couple.

You will need to include that divorce certificate. In fact, I believe you are now married twice to him. So add 2 to the rest, that is, if you have been married to someone else besides him. I believe this question is somewhere in the I-130 & I-485..can't quite remember but I know it is there somewhere.

will we send one $1760 check for the 3 fees - ($535 + $1140 + $85) or the $535 is separate from the $1125 AOS fee? $1760 is accurate. Get a money order. I cannot stress this enough. USCIS and CC authorization/ personal checks are not the best of friends. You can find stories of such here on VJ.  

I believe they have $1000 limit. So it will be $1000 & $760. 

 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

@Fancyaa, you would include all the evidence of bona fide marriage with the I-130. You can include evidence since the time you met, if you feel that would strengthen the petition. 

 

To answer your other question - yes, often times, officers choose to adjudicate the petition based on the evidence you send initially. That is why it is best to follow the I-130 directions and send as much evidence as you can with the petition.

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

I would recogment to separate the payments to two 535 and 1225. That is if one of the forms ends up getting rejected for missing signiture or incomplete or something similar and you did write one check they will have to reject both 130 and 1485, however if you wrote separate check and only one is with errors they will proceed the other one. It happened to my frined and that is what the attorney told ger that!

Thank you! Do you think it's necessary to include a certified divorce certificate or just the record from the courts?

Never had issues with the bolded.

And checks are capped at $1000...So thats why most go with $1000 & $760. I've helped a plethora of people do that and none has had an issue.

@Fancyaa we sent a copy of a certified copy of final judgment of dissolution of marriage. I would send a copy of the most official document that shows clearly the previous marriage is legally dissolved.

Ok, good. I have never seen it done that way. :) It is good to know that works, as well.

In-between, Its  535 and 1225 not  ($535 separate from the $1125 ) as you specified

Just a note that if the issue is with I-130 payment then everything is rejected per 8 CFR § 103.2. I.e. the I-485 would need a properly filed underlying petition.
