K1 Visa widthrawal

Hi guys. I hope you can help me.

Me(beneficiary) and my Fiance(Petitioner US citizen) filed for K1 Visa petition last March 2020 and got approved January 2021  but unfortunately our relationship didnt work out because of this Covid19 and Trust issues. As the beneficiary I dont have anything to do to widthraw it. If ever I met someone from the US again in the future and planned to file again, What would be the outcome to me in the future and how long do I need to wait to be petitioned again ??  And what is better to file next time K1 or the CR1 ? Thanks in advance for youe help.

A withdrawn petition should not have any impact on a future petition/visa application.  I don't believe there is a specific time period to wait for a new petition other than to show an actual relationship (i.e., USCIS or a CO may take notice of a new petition immediately after a withdrawn petition from another person).  As to K1 vs CR1, there is a lot of discussion on this which you can find using the search tool here on VJ.  In summary, a CR1 is a superior visa than a K1 for a lot of reasons, immediate GC upon entry into the US, no need to wait for other submissions (I765/I131) to work and/or travel.

Thank you. But the petitioner doesnt want to widthraw our case  in the NVC 😢

That really depends on you, your fiancé(e), and a lot of other factors.

 

The CR-1 is a better visa, but if it's difficult to marry a foreigner quickly in your country and/or difficult for you to get a US tourist visa, a fiancé(e) visa may be more practical despite the downsides.
