Evidence for Domicile

Hey guys!

 

So I have been in the Balkan region for about a year, traveling with my Serbian fiancée. We started the K-1 Visa process last February, and according to our estimates we should be able to move to the US around March, if all goes well. We have been doing extensive research on what might be expected from Packet 3, after we receive our NOA2, and we see that I must be able to prove my domicile in the United States is permanent, and I have always had the intention to return. 

 

I'm currently unemployed, but we have been doing odd volunteer jobs throughout Serbia, Bulgaria, and Albania. Our current plan is to keep doing that until we get our Visa approved, and we can't really give confident statements on when exactly we'll be able to return, obviously, or even reliably search for jobs in the US when we're 9 hours ahead and can't say when I would be able to reenter the country.

 

Is this considered just one big trip? My fiancée has not filed for residency in any other countries, so we are hoping we don't need to bother with any extra police checks from the places we have spent approx. 6 months spread out over a year. I also don't have any formal visas in my passport for these countries, only stamps, which I plan to include. Other than that, we are planning to submit the following for proof of domicile:

 

- Mailing address (NOA1 was sent to my parent's address in Seattle, where I am registered permanently)

- Bank statement

- Copy of active driver's license

- Tax returns from last 3 years

 

Does anybody have any suggestions, or have they been in a similar situation to us? Will this be enough to satisfy the requirements? Separation is not an option due to COVID, we don't want to be apart again.

Another form of secondary evidence is the dog that we're adopting that will be fostered by my aunt in the US until we get there since he will be in the country a couple of months before us. We can ask her to write a statement explaining this, along with attaching his adoption papers and correspondence asking her to foster him.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Job offer? Lease or other proof of where the two of you will be living? Have a vehicle in the US? Car insurance? Health insurance? Voter registration? The secondary dog information could be used. Here's a thread with someone's letter to re-establish domicile. Could give you ideas. 

 

You can also do a search for intention to re-establish domicile, and are sure to get ideas of what to provide.
