We did DCF. The domicile issue through us into AP.

AP = Administrative  Processing.

That is the phase after the interview when they spend more time reviewing your application before they render a decision.

How long it lasts is unknown. It could be hours, days, weeks, or months.

So, it is great when that does not happen, of course. The stronger the case,  the greater chances you have of not having an extended AP phase.

 

When our Immigration Officer interviewed us during our DCF, he said the ONLY question he had was the question where the US citizen petitioner was domiciled, in the US or overseas. Nothing else.

He said he would review our documents later that day, and we might know the next day, or we might not hear back for a week to 10 days.

It took two more weeks, and only after we provided evidence that I intended to return to the US as a resident.

When we went back after about two weeks, they told us we would get the visa the next day. Which we did.

We were both in the US two weeks later.

and what type of evidence did you give them to prove your intent to go back

You will have to demonstrate extenuating circumstances to be considered for DCF.

If you are working and living in the US, then how do you establish to Immigration/Counselor Officer satisfaction, that you meet basic qualifications for DCF? In other words, WHERE DO YOU RESIDE, OFFICIALLY? In America or NOT!

Do you see the challenge?

AND, you need to provide extenuating circumstances to even qualify for DCF, in Uganda!

It depends on how they interpret it. I am living in Uganda but in the US to work for a short time. I have no idea what they will say or even how to get started with it

Yes, correct.

You have to get in the DCF door.

And you have to have pressing work/need to be in the US.

And your income must be US-based for financial support.

 

Questions:

1) What do your tax returns say for the last year or two? Where did you say you were resident?

2) Did you vote in 2020? If so, how...absentee overseas or not?

..etc.

Last year I was working for 3 months, I have tax records of that but my address on them is a US address. But I own a place in Uganda where my wife is currently living. My boss really needs me to be back permanently. I don’t know if that’s enough

Good.

You have a lot going for your case, but you have to put it all together and be ready.

It only takes one thing to cause a problem.

 

So, look at each element that is important, and deal with them directly, including:

Income-wise: Do you satisfy the US-based income requirement for your household?

Overseas Residency: Can you provide evidence that you now live in Uganda to justify DCF processing?

Extenuating Circumstance: What hardship do you experience that supports your not merely waiting for regular non-DCF processing.

Domicile: Can you provide evidence of your intention to live in the US once the visa is issued. ("Live" is more than just having property there).

Assemble your case based on all the elements, and then back them up with evidence.

 

So far, you have many of the elements. Just get your case together.

For Ugandan residency, that is very good. Should qualify you for overseas residency,  and for basic DCF.

 

Your boss needing  you now in the US full time is great for domicile,  and helps for extenuating circumstances

Do  you have an employment letter from that same boss?

If US-based income is high enough, should qualify you for sponsorship, otherwise you would need a co-sponsor with US-based income.

 

So, you  have a case. Just get it organized, and well-documented.
