My father in-law never received a  i-94 I just went thru his paperwork but my wife is  still  waiting on her interview

Cbp doesn't hand that out anymore. You can check it online, just google I-94 CBP.

Is the Form I-539 still pending?

Right, I overlooked that - assuming more than a year unlawfully present. It seems to just add time and money though, I get the impression from VJ that any good lawyer can get a waiver approved.

For the waiver he would need a Qualifying Relative. OP's wife does not qualify per INA 212(a)(9)(B)(v): "The Attorney General has sole discretion to waive clause (i) in the case of an immigrant who is the spouse or son or daughter of a United States citizen or of an alien lawfully admitted for permanent residence, if it is established to the satisfaction of the Attorney General that the refusal of admission to such immigrant alien would result in extreme hardship to the citizen or lawfully resident spouse or parent of such alien. No court shall have jurisdiction to review a decision or action by the Attorney General regarding a waiver under this clause."

Ok if you say so … then they have in fact well and truly messed up.

October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
