VAWA officer approved my Green card application and did not cared much as it was mere class C misdemeanor conviction.

No I don’t think you gonna have problem with that,  one time class c is nothing you gonna be ok good luck 😊

Hi everyone,

 

I filed for VAWA back in May 2019 and yesterday I got an RFE asking for:

  1. Proof of legal termination of marriage
  2. Permanent resident card
  3. Extreme hardship

My attorney says USCIS made an error because these aren't documents needed in a VAWA case. Does anyone have a similar experience to this? I'm excited that my case seems to be under review finally but I am nervous.

It all depends on what you wrote on affidavits.

1) If you are fulling within 2 year after divorce and they could not verify your divorce then the may ask for divorce paper.

2) If your spouse is not a US citizen then you need her PR card or you need to prove that she has PR.

3) Extreme Hardship i am not sure - may they are refereeing to abuse related stuff?

1. I filed VAWA when I was married to a US citizen. I am filing VAWA to remove condition of 2 years of marriage from my temporary PR status. I later divorced a few months after filing VAWA. Attorney assured me divorce status does not affect VAWA petition.

2. I had already submitted a copy of my PRC with my VAWA petition so it is strange they are asking for it again.

3. I attached a PDF of what they are looking for in detail but this seems like an unusual requirement for a VAWA petition?

I am no sure but I think you file i-751 to remove conditions on GC.

 

I am not pro but this seems confusing to me.

 

I though you apply for vawa if you do not have i-485 filled or approved,  if you have i-485 approved you do not need to file VAWA you need to file I-751.

You're right, I meant to say I filed I-751 with VAWA waiver. MY PRC was temporary and I had to reapply for a permanent PRC after 2 years of being in marriage. I'm sorry for confusing you and I hope this makes sense.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
