if you look at the numbers something happened in 2020 there were 40,000 Applications approved for special immigrants.

Vawa instead has only a steady grow on pending cases which is not good for us.

also the denial % is way up for vawa applicants.

so I think I doesn’t really justify the processing times.

C31 I-765 is handled by VSC regardless of where you live. From the USCIS website the receipt date for case inquiry is July 25, 2020. Yes, you can contact VSC yourself, but due to the privacy "protections" of VAWA you have to write to them. Personally I would recommend contacting your congressman or senator to have them ask what's up.

You will definitely get an answer that's "It's within processing times, go away", but chances are that since someone had to take the case out of the pile they'll just approve it. I had this happen with my DACA renewal (also at VSC due to being a VAWA filer). I contacted my congressman regarding my I-360 and my DACA, got a response that's "it'll be done when it's done" for both, and the following day my DACA got renewed.

Yes ill probably need to do that ,thank you very much ,do you remember how long it took them after you contacted the congressman ?

c31 vawa approvl inquiry is july 25 2020 ??? really?that means our approval is coming soon too.

Just the I-765 for a C31 renewal. It's lumped into "All other applications for employment authorization". Though since these are handled by the special VAWA team I'd imagine it's much less than that. The inquiry date for VAWA I-360 is June 24, 2019.

About 2 weeks after they got the inquiry.

I have been hearing about contacting the congressmen, my question is I have visited the site, but how do we contact them , do they reply to emails or we should schedule appointment to meet in-person

You can call them and explain your situation.  If you see any email info try to reach out to them ,but I think call is the best

Hi Everyone. I am hoping you can help me. I am currently experiencing negative events in my life right now that are both emotionally draining and psychologically challenging. It is taking a toll in my health. In summary, I am the applicant and married to a USC spouse. Although we have been together for 10 years, we have only been married in the last 6 months. We filed I-130, I-485/I-131/I-765 in June 2021. I am in a same-sex relationship and is a victim of emotional abuse. This includes telling me what I can and cannot do (eg cannot watch TV, cannot drive a car, controlling the food that I eat) and threatening immigration action since I do not have status in the US). We used to live overseas for 9 years and moved to the US after marriage. No judgment please: If you are wondering why I have stayed in the relationship for 10 years and even agreed to get married 6 months ago, it is because of love and I can’t really explain why other than I fear for what will happen if I end it. The situation just became worst when we moved to the US as I do not have any family or friends here. They are all back home outside the US.

Question 1: If I file for I-360, what happens to the i-485/i-131/i-765 that is attached with i-130 that was filed in June? This will become void, correct?

Question 2: If I file for I-360, do I have to start over again and refile the i-485/i-131/i-765 concurrently?

I would like to know if I should just continue to take the emotional abuse or if I have the option to running away and hiding. Please provide some advice.

Dated mines for approximately 6years before marriage and abroad… going to 2 years in marriage. I understand how you feel with the sudden change in behavior now that you’re in the States.

Also did my initial filing feb 2019. Your lawyer can convert the i130 to i360 to reduce your wait time. Mine didn’t. I started afresh with an i360 just in May. I’d advise you to go back to the thread comments here to gain more knowledge on Vawa. This has helped me. I read daily till I got to the current comments.

I wish you best of luck in this journey. Keep busy with online certifications, make friends (online/in-person) if you can, gain as much knowledge as you can about the whole process but the key is patience as I’ve been rightfully advised on here.

Hey Experts,

I need some help regarding my citizenship application after VAWA green card which I got in 2018. I was having class C misdemeanor conviction in my record of county court.  Will this conviction can hinder my citizenship. Any update on this.

VAWA officer approved my Green card application and did not cared much as it was mere class C misdemeanor conviction.

Can I impact my citizenship ?

Any help ?

Yeah there is:

https://www.uscis.gov/sites/default/files/document/reports/I360_VAWA_performancedata_fy2021_qtr2.pdf

In general the approval rate hovers around 80%.

There's no real public statistics for AAO appeals, but from my own digging it looks like roughly 5% win the appeal (either get an approval by AAO or a remand back to VSC) once it gets to that stage. This is just my guesstimate from reading through their non-precedent decisions.

It depends if the C misdemeanor Conviction is a moral turpitude classification  https://www.uscis.gov/policy-manual/volume-12-part-f-chapter-5  but in my opinion it will be fine since my ex abuser got his US Citizenship with E Felony on record. USCIS always surprises me, they knew about it, question him about and they gave to him anyways.
