Sandranj how is it possible that you apparently have some I-360 approvals from 2020 if we are still waiting from 2019 and 2018 filling?

Another question have you and everybody else seen special immigrants fillers who also file i360 processing time changed to super short? Why are they treated so special? We are the ones who suffered/suffering abuse and are/were not safe on in danger of our lifes..is that not enough to speed up processing time..just wondering!

Because Special Immigrants only have 9.000 applications pending vs.  VAWA having 34,000 pending

nope. I360 shows - name was updated on Dec 31st 2019 and that's it. Current EAD class C09P - whatever the P means - can somebody clarify that please?

Name updated 9 times out of 10 that means that somebody touched the case and put it back on the to do stack. It just appears randomly.

P stands for parole. It's a combo card that you can travel internationally on. It says "Also serves as I-512 advance parole" on its face on the bottom.

Hello Sandra @sandranjand everyone

Do you know how long it takes to update ead under c31 now in nyc. I can't find it in the processing time as they changed the chart again today. mine is almost 4montgs pending already. If I'm outside of the processing time us there anyway I can contact uscis myself ?

C31 I-765 is handled by VSC regardless of where you live. From the USCIS website the receipt date for case inquiry is July 25, 2020. Yes, you can contact VSC yourself, but due to the privacy "protections" of VAWA you have to write to them. Personally I would recommend contacting your congressman or senator to have them ask what's up.

You will definitely get an answer that's "It's within processing times, go away", but chances are that since someone had to take the case out of the pile they'll just approve it. I had this happen with my DACA renewal (also at VSC due to being a VAWA filer). I contacted my congressman regarding my I-360 and my DACA, got a response that's "it'll be done when it's done" for both, and the following day my DACA got renewed.

my lawyer told me 2 days ago that he will no longer do immigration cases, and will transfer my case to another lawyer, including mine, if I wish to continue with the new lawyer, will this delay the i485 process that was submitted on dec2018?  my vawa was approved on march 2020, I will need to renew my work which lawyer has to change the address where uscis send the correspondence to me? does the new lawyer have to file a g28 with me so he/she can represent me?
I will need to renew my EAD in October, how can I make sure that the new lawyer will renew successfully the new ead? what documents from my file does the new lawyer need to do the ead renewal and possibly come with me at a potential i485 interview?  who transfer my complete file from my old lawyer to the new one, is this done by me personally or does the old lawyer sends it to the new lawyer, please help

Hi Everyone. I am hoping you can help me. I am currently experiencing negative events in my life right now that are both emotionally draining and psychologically challenging. It is taking a toll in my health. In summary, I am the applicant and married to a USC spouse. Although we have been together for 10 years, we have only been married in the last 6 months. We filed I-130, I-485/I-131/I-765 in June 2021. I am in a same-sex relationship and is a victim of emotional abuse. This includes telling me what I can and cannot do (eg cannot watch TV, cannot drive a car, controlling the food that I eat) and threatening immigration action since I do not have status in the US). We used to live overseas for 9 years and moved to the US after marriage. No judgment please: If you are wondering why I have stayed in the relationship for 10 years and even agreed to get married 6 months ago, it is because of love and I can’t really explain why other than I fear for what will happen if I end it. The situation just became worst when we moved to the US as I do not have any family or friends here. They are all back home outside the US.

Question 1: If I file for I-360, what happens to the i-485/i-131/i-765 that is attached with i-130 that was filed in June? This will become void, correct?

Question 2: If I file for I-360, do I have to start over again and refile the i-485/i-131/i-765 concurrently?

I would like to know if I should just continue to take the emotional abuse or if I have the option to running away and hiding. Please provide some advice.

Why don't you schedule a meeting with the new lawyer to discuss all of this and express your concerns about the change.  The roles and responsibilities of whom does what is a discussion between all three of you.

I forgot to add that majority of the Special Immigrants are children that are currently in court custody due to child abuse and neglect or were abandoned by their parents in the streets of the US.  So that is why they receive special treatment.

If you can endure than just wait for the I-130 and after you get your conditional green card you can leave and later apply for the permanent gc by proving your good faith...

If you can’t endure just file for the I-360 as soon as possible and gather as much proof as you can. (You can keep I-485, I-765 and I-131)

So you have an idea I applied like you on March 2019 and got my interview letter for November and sadly things went really wrong and I felt forced to apply for vawa on Jan 2020.

Now we are in August 2021 and I’ve no clue about when I’m going to get my green card and it looks like it’s pretty normal here for people to wait 2,3 or 4 years.
the regular process would had taken 1 year for me.

when you have an us citizen on your side it’s a lot different than when you’re by yourself, after you’ve been abused by your spouse you’ll feel forgotten and mistrusted by the state.

wish you the best!
