What does 'security check' mean and how long does it take? Do you think I should contact the senators ( not congressman) and is there anything I can do in this situation? It's been 26 months and still waiting. 

* I have regularly received a Prima Facie certificate almost every 6 months and have never asked for an RFE

 

You are stuck in background checks, and your case will not move further until your background checks have been completed.  They will be asking you for another set of biometrics soon and that will make them do another set of background checks which will be faster.

October 6, 2017 We received your case and waived the filing fee for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

Hi everyone.  Please,for those who are in college here, do you ever write a letter of non incarceration? Have been requested to write it before the school can approve my financial aids. I dont have any criminal records,  have not been in jail or any penal institution. Been worried since i got the email. TIA

Security checks are federal background checks and they sit with the FBI until they run your prints, name, aliases, facial recognition, and hopefully it comes back clean. I suppose you could have your representative look into it, but they'd have to hit up the FBI rather than USCIS regarding what's the hold up.

NYC is taking 14 to 20 months to process I-485 after They received your Vawa approval. I seen less time 9 months for another person, I waited 17 months so hang in there should be soon.

This is randomly sent, I always received this Jury duty paper even when I didn't even had my EAD. but took out an NYC ID they were giving you can filling it up online and sent copy of your EAD

i did a biometrics on I360 is that mean i am sucking in background check too "?

Hello everyone!

 

I have a question about changing my last name. I'd appreciate any information!

 

A little bit about my case: My I-360 and I-485 are pending since September 2018. I did a few congressional inquiries and they are saying my case is going through background checks. I have finalized my divorce in October 2019. In my Judgement of Divorce the judge stated that I can go back to using my maiden last name. 

 

I talked to my lawyer a few times about changing my last name but her response is that I have to wait until my VAWA is approved.

 

Is that really the case? 

 

Using my abusive ex-husband's last name causes me so much discomfort and pain. I already started using my maiden last name as a preferred name everywhere. And I just can't wait to get a new id with my maiden name. 

 

Right now all of my documents have my marriage name - SSN card, EAD, Driver's license. The only documents that have my maiden name are birth certificate and the Judgement of Divorce.

 

What should I do? Is it possible/safe to change my last name before my VAWA is approved? Is there a specific form I can send to VSC? Thank you!

I have this same situation all my legal documents have my marriage last name Green Card, Real Id License, Bills, Passport etc.. and to be honest I'm going to keep it until I apply for my US Citizenship and change it... I do not want to pay to replace my Green card  when I just got it. and with Covid all state office DMV, Social Security are very complicated to get an appoiment is ridiculous.  Check if VSC can change it but they are very messy with changes.

@sandraj I had a very weird/interesting at the interview. I always thought the local officer is not supposed to ask you anything about the abuse, divorce, separation but this one asked me all these tthings?! The I360 is still being adjudicated so when I asked for an abeyance , she started asking about the abuse and then asked the yes/no questions. When I asked in a nice way if we are going to do the interview again after the I360 is approved she said she's doing the questions now so I won't have to come back after the I360 is approved.

 

Sandra, is this normal? Can she really have me skip the interview since we did the yes/no questions now?

You can go back to the old name whenever. There's no particular form you'd use for this and there's two ways to go about this:

1. Send in a letter where you request them to update the name.

2. Send in amended forms I-360 and I-485 (basically grab the forms, fill them out with an updated name, date and sign them, and write AMENDED on top of the first page of the forms). A cover letter explaining that you are submitting these amended forms for a name correction also wouldn't hurt.

Include a copy of the I-360 and I-485 receipts and a copy of the divorce order letting you go back to your maiden name.
