Hey VJ family, is it true that USCIS policies changed with Biden, That nomore straight DENIAL for any case? That IO are obligated now to send RFE or NOID for any case before final decision?

Since 2018  immigration officers have full discretion to deny applications without issuing an RFE/NOID .

Hi friends. My VAWA was approved Jan 2020. Got my interview and GC Jan 2021. Summer 2020 I applied for C31 EAD and received a denial last month due to being a permanent resident by then. Now I got a notification from USPS that there's a letter sent to me from VSC last week but somehow it didn't have an apartment number and I never received it. Does anyone know what can it be? Should I ignore or try to struggle to find out what it was through the senator?

You got the green card then you are good.

Hey guys! Congrats with moving to another tread!

And congrats to everyone who is been approved!!!
And the best wishes to you guys who is still expecting. I know your pain! Trust me🙏🏻
Finally I got my green card in mail. After 2 months of fighting with USCIS. It was a struggle guys!
But long story short. They sent the cards but forgot to put an apt# 🙄

I went to INFOPASS where we changed the address in their systems.
I will write a big post later to those who is in the same situation.

So I got a card. But guess what? They send just mine. My son still didn’t get a card🤦🏻‍♀️

But I came here to ask another question. When we are allow to apply for citizenship?
Is it 3 or 5 years?

Thanks guys!

If your ex husband is a citizen you can apply within 3 years but if he is a LPR, you can apply within 5 years. My question is did you go to the interview with your son? If yes, how old is he and did they ask him any questions? Asking because I just applied and I included my children in my application. So  I will like to know how it works if children are included.

1. The 3 and 5 year rule to apply for US Citizenship depends on the status of the abuser, If your abuser was a US Citizen when you applied Vawa and I-485 you can apply in 3 years.

2. If the abuser was an LPR when you applied Vawa but he became a Us citizen after your I-360 was approved you can also apply in 3 years.

3. if the abuser was an LPR when you apply for VAWA, and he did not naturalize before I-485 approval, than you must wait 5 years to apply for the Us citizenship.
