*** DO NOT RESPOND TO THIS E-MAIL ***

There has been a recent processing action taken on your case.

Receipt Number: MXXXXXXXXXXXXX

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

Your Case Status: Testing and Interview

As of July 1, 2021, we are ready to schedule your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS, Receipt Number MXXXXXXX, for an interview. We will schedule your interview and send you a notice. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

If your case status indicates that you are currently in this step, you have either been scheduled for an interview or are in line to be scheduled for an interview. The amount of time your application will remain in this step will vary by office and is largely determined by the number of cases ahead of yours. The interview notice will have specifics about time, location and anything you will need to bring to your interview. If your application remains pending beyond our normal processing times (as shown below) please contact our national customer service center at 1-800-375-5283. Please note that not every application/applicant will require an interview. In some instances, an interview is required by regulation and others an interview is requested because USCIS has determined that this is the most efficient means to determine eligibility. For a naturalization application the interview will include your taking the required English and/or Civics tests (unless exempt or waived).

  • Log-in to your myUSCIS account to view your case history and understand what you can expect to happen next on your case.
  • Current processing times can be found on the USCIS website at under Check Processing Times.
@Sandradj @Stillwinning!!!😊

Sincerely,

The U.S. Citizenship and Immigration Services (USCIS)

I had the same issue, thankfully I had received the VAWA application receipts. My attorney sent a cover letter with the denial notice(130 and 485 denied) and the VAWA receipt notice to the local USCIS office and USCIS called us back to confirm that they scheduled the interview by mistake and that we don't have to go for it.

Actually you can do 2 things.

1- Write a letter to reschedule the appointment till your vawa is adjudicated.

2- Go for the interview. Write a letter with VAWA details and slip it to your IO in case your ex is present. Best to go with an attorney in this case.

Of course they know you have a pending i360 petition, what I want to know is this…did you attend an earlier i485 interview where you asked the IO to hold the petition until your i360 is approved or you simply wrote a letter? How do you know that your i485 was held in abeyance? If everything I’m enquiring about has been fixed, then USCIS is being “messy” as usual! You need to contact your congressman immediately to be reassured of your case status! Also be ready to attend the interview with your i360 receipt to re-inform them your i360 is pending and that you believe your i485 is held pending vawa adjudication. Don’t be too hard on yourself dear!👍

Hey VJ family, is it true that USCIS policies changed with Biden, That nomore straight DENIAL for any case? That IO are obligated now to send RFE or NOID for any case before final decision?

Not true for all cases.  Only true for cases where additional evidence might help.  But for cases where the evidence submitted is already enough for USCIS to make a decision, no requirement to issue RFE or NOID.

Key points from the policy alert -- https://www.uscis.gov/sites/default/files/document/policy-manual-updates/20210609-RFEs%26NOIDs.pdf

  • Explains that an officer should generally issue an RFE or NOID if the officer determines there is a possibility the benefit requestor can overcome a finding of ineligibility for the benefit sought by submitting additional evidence.
  • Emphasizes that officers should not issue unnecessary RFEs and NOIDs, such as in cases where the officer determines the evidence already submitted establishes eligibility or ineligibility for the benefit sought.

yes dear, i have told  uscis to hold the i485 to hold in abeyance. Also, after 11 months they asked for my fingerprint for the i765 and i485 and within two days i got the notification yesterday. I guess they took action after i inquired through congress. I hope my vawa is approved soon :( i still did not get my EAD under c09 . My PD for i30 is August 2020
