Hello guys, I'm new to the this Forum. I really need advice from someone who has experienced everything I'm going through right now.

 

My conditional green card was approved and received. Last week my husband hit me and smashed my phone (not the first time). Our neighbor heard of our arguments and my screams, he later came down and rescued me. 

He also called the police for me. When the police came, my husband refused to open the door or answer his phone. So the police had to send me to a women's shelter.

 

The detective called me today, but I don't know what should I do. I'm afraid if I tell him everything and my husband will get arrested. But I'm also afraid that I won't be able to get a full police report if I don't cooperate. I don't want to press charges nor getting him in Jail. I love him and I want him to have a good life just not with me. I can't deal with his abusive behaviors anymore. But someone at the shelter told me that I need to file a protective order and get as many evidences as I can so when it comes to filing VAWA my case would be stronger. 

 

So I want to ask you guys what should I do? If I don't have a protective order against him or ask the detective to close the case right now, would my VAWA get approved?

Evidences of the abuse that I have: 

1. photos of bruises on me (throughout the entire marriage)

2. Photos of my phone that he smashed

3. Police report? (I don't know if I can get it if I stop cooperating)

4. My friends from Church who know about my stories

5. Shelter intake form

6. Shelter's counselor's notes

7. texts of him threatening me

8. witness affidavit (my neighbor)

1. How do they know you/your spouse 

2. Whether they have visited you at your residence. If so, what activities did all of you engage in, how did your house/apartment look like (furniture, how many rooms etc.)

3. How did you and your spouse behave out in public? Were you holding hands? Hugging/kissing/arguing/joking etc? Was he/she respectful/nice to you? Was he/she rude/inappropriate?

4. Did you and your spouse share details about your courtship/plans for the future with your friends? F.e. Maybe you wanted to get a dog/cat/kid/new car/house together and told your friends about it?

5. Did they notice any “red flags”? Any changes in your/spouses behavior? Did they witness any abuse? 

 

basically, your friends need to describe your relationship, your love story and your relationship issues ( if they have noticed Sth obviously) in details. A lot of details.

you dont need to file for vawa since you have approved conditional green card, you wait 2 years and apply i751 to remove condition on you green card under abuse!

I applied for the renewal of my EAD(C09) in Oct 2020, got EAD(C31) in Jan 2021, did biometrics for EAD C09 July 2021 and since then nothing. It’s almost one year now for the renewal and the other one is going to expire in January. I raised a service request for out of processing time since September 7th, not even been assigned to an officer. I’m afraid   January is around the corner and don’t want to be out of job. Has this happened to anyone and is there anything I can do?thanks

Check what USCIS wants first and then post your checklist here.

 

I will try to help as much as I can, but just letting you know, I’ve got an RFE which is still pending, so I am NOT the best person to advise you on your checklist hehe

Why does uscis says if case has been pending more than 105 days to request inquiry, but when you request inquiry they say you are still within acceptable time frame, am I missing something?

It’s for EAD not the 485 application . As you can see above 485 processing times is between 5.5-10.5 month .

Is it for your 485 being outside the normal processing times or you did a service request for I-360?

If you have conditional green card . I would think the best course of action would be to apply I-751 (petition to remove conditions  of  residence ) solo with a waiver as a battered spouse .

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We ordered your new card July 17th, 2021, approved September 10th, 2021. I need a quick response before my head blow up from overthinking

 

They are requesting for your medical most likely . If they request it to be mailed in . Hopefully they will waive your interview abd approve your GC

Oh Btw if your C31 expires on January it automatically gets extended for 180 days if I am not mistaken . So hopefully by the time of extension you expiration you will have GC or EAD on your hands.
