Really, is this a rule? And when do they decide to close it, then? If they didn’t do it after the interview?

Hello. I’ve applied for VAWA back in October 2020. Only received my receipts. No RFE or biometrics to this day. My case was updated to correspondence was received and uscis is reviewing it 14 days ago. Anyone on here has any clue what’s going on with my case or has a similar situation? Filed I360, 485, 765 and travel  document all together.  Please advice. Thanks

If your spouse a GC holder, you have to wait until VAWA approved to apply for I-485 and EAD.  THat is the rule that has always been in place.  If your spouse is a US Citizen, then they can hold your I-485 (as a courtesy) and your EAD will remain active.

 

THey do not have to hold either one, they can deny I-485 for both categories, and you will just have to re-apply.  They can close it at any time,because you do not qualify for the GC until VAWA approved.

Thank you! I understand the rule that you are mentioning ("If your spouse a GC holder, you have to wait until VAWA approved to apply for I-485 and EAD"), but I have not read nor heard anywhere this distinction between citizen/GC holder. My spouse is a GC holder, we were about to complete the adjustment process: I went to the GC interview with my attorney who explained the situation, and my I-485/EAD have been held since then. And for the purposes of EAD, citizens'/GC holders' spouses are in the same category and should therefore receive the same treatment, no?

I have to defer with this. My Abuser was an Green Card Holder, I went to my Marriage interview just like you and I requested my I-485 to be held. My I-485 Was held, I continue to sent my EAD renewals to Vermont Office with a copy of the same I-485 and they all were renewed without a problem, my Vawa was approved as an battered spouse of an LPR , B21 category.

MY abuser became a US Citizen 1 year and half after my VAWA was approved.

If the officer held your I-485 you can still renew your EAD in Vermont Office, Vermont will validate this if they renew it and sent to you. 

Green Card holder Spouse visa has been current for more than 3 years, meaning they do not need to wait for Vawa approval to apply for I-485.

Sounds great, thanks a lot (and congrats!!)! I did request an EAD renewal back in June, my fingerprints were applied (I read this on my "Case status online") and I am waiting to hear from them. I wonder what is the processing time between applying the fingerprints and issuing the EAD though, it is taking longer than it did for the first one. My EAD is going to expire in October, but I understand I have an automatic 180 day extension mentioned in the I-765 receipt notice.

Remember must be sent to Vermont Service Center. Renewals are taking from 6-12 months unfortunately.

Hi I’m October 2019 filer.

 About 3 weeks ago(24days ago), my i-360 case status changed to “new card is being produced” and then “card was mailed to me”. But, so far, there is no mail to my lawyer’s office(all my immigration mails are delivered to the office).

 

1) If there is anyone had experience of getting these notifications online and got EAD(c31), could you please share how long it took for you to get the card?

 

2) As informed, I tried e-request because the mail was not delivered. I chose the option that I checked in the photo attached because in other form there was no i-360 form option.. so my question is: is it the right section to request resend the card(that was not delivered)?

I-130 Priority date transfer will not mean faster processing time when it comes to I-360 this only benefits LPR battered spouse when I-360 is approve it gives them the opportunity to apply for I-485 without a visa wait time (But this has change since Visa are current for couple years now). For Abuse spouse of Us citizen don't make any different.
