Also, I received today notification that my case is officially approved!!!!! AFTER 14 days from my card being produced. Super happy! 

For whom is still waiting... It's not easy, I, myself, waited 33 months! Stay focus and don't lose hope. Come here and find comfort. ❤️❤️❤️❤️

First of all congrats ! I have my EAD C31 card for over 3 month now . I have put in a Service Request which they should get back to me within a month . That date is coming really close with no response in sight . I also had my lawyer email an update request to their specific hotline email . Which according to their memo they are supposed to respond within 72 hours . It’s been over a week not a beep .. I have read on the Reddit that it kind of happens random for some reason. Sometimes they call and hang up real fast . So everyone’s guess is as good as yours .

My attorney advised me not to exit the country as I was out-of-status for a few days while we replied back to the I-130 NOID with the I-360 and that it's risky even though I've the VAWA - EAD-AP. The was worried about getting an RFE or NOID on the I-360 while I was out to get the H1b stamp. I wanted to be on H1b as a backup while waiting on the I-360 but now I'm not sure if it can be done.

 

Is it not possible do a COS to H1b via consular processing using the EAD/AP to travel?

Yes. You can exit the country while VAWA is pending as long as you have the travel AP. Be sure not to use the AP on your return, instead activate your H1B at point of entry. It doesn’t violate your current VAWA petition. I’ve done it before

You don't need to submit your W2.

This is incorrect. The consulate will not deny your H1B due to pending VAWA. H1B is a dual intent visa so the intent to immigrate is irrelevant. Like I said before, you will however need to re-enter the US on your new H1B visa stamp, not the AP. The AP is only, if for some weird reason, you’re not able to obtain your H1B visa stamp. This is my current situation - I’m on H1B while VAWA is pending.

Yeah I'm not sure what to do with this then, because in theory if they reinstated your F-1, you should be able to just do a change of status to H-1B. But at the same time, the damn thing popped out of nowhere, so the moment you try they'd probably just go "whoops, that wasn't supposed to happen, we're pulling it back".

 

If you want to do consular processing, you've only got about a month of unlawful presence that I see, which is well below the 180 days needed to trigger a re-entry bar. Just travel on advance parole for the H-1B consular interview and return on H-1B. If they were to deny you just give them the finger, come back to US on advance parole, and finish the I-360 AOS.

I have experienced 2 times where uscis did call me with 48 to 72 hours. Did they give you a number that will show up on your caller id? In my case they did.

It depends where you live. In New York  i got appointment 2 weeks after i spoke to uscis.

I highly suggest to use the Case Outside of Processing Times online form if your case is delayed. They responded to my inquiry in 5 days and this triggered the card being produced. Maybe they did respond since my case was so delayed. Anyways, this time it worked!

Yeah, seeing that odd i94 made the employer's eyes sparkle as it meant that they can reissue a new i94 for H1b, some process they do very often, but I have 0 idea about.

 

I was also planning on doing the same thing, i.e., travelling with EAD/AP, getting H1b stamped, and returning with the stamped H1b; OR if H1b does not go through (for some weird reason) returning with the same EAD/AP; but my attorney still advised me to not to travel internationally as I don't even have a PF yet (she suspects that my ex wrote some fake story about me in the i130 withdrawal letter that was sent to USCIS but I don't suspect it BUT I've been wrong before about my ex hence my trust on the attorney). Let's see, once I start working and once the COVID-related travel bans are lifted I will try to consult with my attorney once again, I don't want to go against the attorney's advise or piss them off since we have some time with a valid EAD for 2-years. If the attorney still suggests against it I think I may have to get my case evaluated again legally from one of the attorney's here for a 2nd opinion.

Good Saturday Everyone, 

I am 2020 filler, i am seeing few people getting approval from 2020 in different forum. My  case has been in initial review since april 2021, and the message is been showing "Correspondence has been received and uscis is reviewing it"... the same status updated again in June 2021 without no notification i was checking my status and saw same update. Should i expect a decision within 120 days? i am on 81 days since last update..

Yes! I got the number! Such a patience you have balo on calling them 2 times LOl. I waited 68 minutes. Anyway... What was the reason of the appointment? Issuing advance parole?

PF has nothing to do with travel or your VAWA case.  It is a waiver to obtain benefits that is all.

I wonder how long it took for you to receive the card (ead c31) after they changed your case status for i-360 to “card was mailed to me”.

 I am currently stuck on that status. It’s been a week after they updated the case status.


I’m a 2019 october filer i-360 .
