H1b was approved with my employer in 2021 under consular processing after I had gone out of status and after i had applied for i136. Currently my status is that I'm on a pending i360 with a valid c09 ead-ap but my i94 still shows an older F1 status which my employer thinks can be used to convert to an H1B i94. The following timeline will add more clarity to it:

 

March 2020 -

AOS from F1 to i130 with i485, i765, and i131 applied in March 2020.

 

June 2020-

OPY-EAD expired in June 2020.

 

Aug 2020-

F1 expired in Aug 2020 around i94 became inactive.

 

Sep 2020-

Received i130 485 based EAD-AP in Sep 2020.

 

March 2021-

i130 was revoked by my spouse and I received NOID revoking the EAD-AP by March 2021.

 

April 2021-

Applied for i136 with i485, i765, and i131.

 

April 2021-

Suddenly I-94 showed up updated and now showing class of admission - F1 with Admit until date - D/S.

 

June 2021-

Company applied for H1B via consular processing.

 

Aug2021-

H1B approved.

 

Sept 2021-

C09 EAD-AP approved.

Did you apply for an extension or reinstatement on the F-1 or it just was issued completely randomly?

What about your termination? Do ou know how long it’s  taking one  rfe respond from uscis ? today 57 days after they received my rfe responded ! Some people says 60 days some YouTube videos are saying 120 days I’m confused

Right now I'm just waiting on AG Garland to overturn Matter of S-O-G- so I can do a straight up motion to recalendar and terminate proceedings. I thought of approaching ICE for a joint motion but the resources that exist are for the lack of a better term - absolute trash.

 

In regards to after RFE: It took them almost 6 months to approve my I-360.

Woke up to see my i765 is now reflecting fingerprints have been applied to my case. That’s a relief cuz I almost thought something was wrong. Although I took it Aug 3rd, it’s reflecting Sept 10th 🤷🏽‍♀️. I’m just eager to have the combo card in hand so I can work 🙏🏽🤲🏾.

I-360 filed: 08/22/2018

Got a PF denial notice sometime in early 2019. Didn't respond to it and figured that I'll just tackle it come an actual RFE. Didn't need the PFD for anything anyways.

I-360 RFE: 02/27/2020

I-360 RFE response sent: 05/21/2020

I-360 approval: 11/10/2020

 

RFE was just for cohabitation and good faith marriage since I was previously in removal proceedings, so my burden of proof automatically shot up from preponderance of evidence (51+%) to clear and convincing evidence (75+%).

I am very unfamiliar with all the terms but you will surely reach your goals.
