Based on my understanding, USCIS status updates are often all over the place. I had the same status for a while until they sent me an RFE, so it sounds pretty normal IMHO

Can you get AP during the VAWA being pending ??

Did you file I-485, then you can file I-131.  If you did not pay the fees for the I-485 then you need to submit a fee waiver or pay for the I-131

Same here. Had biometrics but status not changed and could make predictions of ones case on tracking apps inaccurate. I guess it’s common though 🤷🏽‍♀️

If he missed something that can cause a delay on your case but it’s better to check with your attorney more often because Uscis doesn’t all the time update the online account

Not everybody gets prima facie not sure why, usually they issue prima facie if they think you can be  eligible for Vawa

I finished my GC journey without prima facie and the journey was smooth.

I think the best way is to contact your congressman to inquire your combo card for you

Thank you for sharing it with us, I feel much better now.

My last employer fired me the moment they got to know about the denied i130 citing 'lowering performance' as the reason but my previous employer and team was very helpful and they offered to help by filling for an H1B and a job to get back to if I ever needed any help and by gods grace I also got an approved H1B consular processing petition with them, now I'm confused on how to start an H1B while waiting on the c09 EAD-AP(4 months no news) from VAWA, has anyone tackled a similar situation here?

Well if you are renewing your Combo card it takes a while maybe from 6 months or more to get your card

Good morning Y'all,

I've a small query.

How long is it taking to get a Prima facie determination nowadays?

I got my receipt notice in the 1st week of April 2021 and no update since then apart from fingerprints reused. Has anyone received their first Prima facie letter recently?

And are there any steps we can take to get PF ?

Also, is there a way to expedite i765 and i131?, and can it negatively impact our vawa application in any way?

Thanks in advance .

I filed in Dec 2020 and got my Prima Facie Determination in the last week of June 2021. So, it took me 6 months and a few days to get it.

For my Combo card, I wrote an expedite request letter, my attorney reviewed the letter and supporting documents;  and emailed them to Vermont, but they ignored it. I mailed the same letter and supporting documents to VSC, they still did not move an inch. They only updated my I-360 with correspondence was received and they are reviewing it. Nothing else!

So I told my lawyer that I wanted to contact my Senator and he said go ahead. I kept my attorney in the picture by forwarding Senator's emails to him as well. My Senator submitted the same expedite request letter dated February (without changing the date or anything - exactly the same things me and my attorney submitted before) and supporting documents to USCIS in July 2021. My Senator came back with a response that USCIS has approved my expedited request. I was surprised. My I-765 & 131 were approved few days after I got my Senator's email, and my Combo Card was sent to my attorney few days after.

Expedite requests have NO negative impacts on any application. It's very fine for them to either approve or deny them. No negative impact.

One more thing is you can reach out to your congressperson to find out if you have missed something

Yes Congress Office & Senator office are the best and more effective way to Expedite Request for EAD, I also experience an Expedite with the help of congress office only*... They will not do it stand alone request.

Someone here said to submit expedite for EAD with new job offer stating you will lose the job if unable to start soon, as that might work. Do this through senator. Also look at 'expedite criteria' on USCIS website, to see if you meet any of those. If you prefer consular processing try going through Mexico if your country is subject to travel ban and closed consulates. But if your consular processing is denied at consulate and you don't have AP, then you will be SOL and your i485 will get denied. I don't know what happens to I360 if you are stuck outside the country.

Divorced US citizen spouse in December 2017.

Filed I-360 on Nov 12, 2019

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020.

Filed C9 EAD / AP Renewal petition in February 2021.

C31 card delivered to attorney's office on Nov 8, 2021.

I-360 case approved status update - Nov 22, 2021.

No RFE throughout.

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date.

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office.

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.)

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.
