It seems you are confusing I-129F petition with K-1 visa. That petition is free to file for a K-3 attempt, but odds are the I-129F will be administratively closed: https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/nonimmigrant-visa-for-a-spouse-k-3.html

I meant the k3 so is it the same thing and alright thankyou!

You seem confused about this entire process.  You've also posted in the DCF forum, which is not your situation either.

 

I suggest you do as much reading and research about spousal visas as you can, to help minimize errors and delays for yourselves.
