Hello,

 

I have been thinking about bringing my mom and my brother to the U.S for a visit but I am not sure what kind of Visa I would need to apply for or who will apply for what. My mom is 63 years old and my brother is 45 years old and both live in Morocco (Casablanca would be the consulate). Mom can't really travel on her own and I am hoping there is some sort of a way to have my brother bring her and visit as well. I am happy to sponsor both of them, pay their fees and their tickets. They are both fully vaccinated. I own a home and have always worked and still do. I am a U.S citizen and so is my wife and all my children. It would be nice for my mother to come see the kids. (This will be the first visit). Anyone out there willing to provide some info/help/tips  would be very much appreciated. Thank you

B2 tourist visa.  Your mom and brother will have to apply for it themselves.  While you can certainly offer to pay for their expenses, there is no sponsorship for a tourist visa.  Having a US citizen family member actually hurts their chances of being granted a B2 visa.  They should focus on highlighting their strong ties to Morocco to overcome the presumption of immigrant intent.

Thank you so much for writing back and for letting me know about the B2 Visa. I would certainly do more reading on it, and see if there are any other options to provide some sort of hard concrete evidence to debunk immigration intent. I wish there was a way to use my house and savings as a collateral because I know for a fact that my mom and brother have no intention to stay here more than 15-30 days to see the kids. Thanks for the feedback, I very much appreciate it.

Think of the decision process like a scale, with US ties on one side and Moroccan ties on the other.  The more the scale tips to the Morocco side, the higher your mom's and brother's chances of being approved a B2 visa.  Your citizenship, house, and savings would tip the scale to the US side, so that would actually accomplish the opposite of what you want.

 

Best you can do is to help your relatives fill out the DS-160 visa application form accurately and completely.  Whatever information they want to highlight about their ties to Morocco, put it on the DS-160 if possible.  The visa interview usually takes only a few minutes.  So most of what the consul officer needs to make a decision is already on the DS-160 and the interview just serves as a final confirmation.

When ties to Morocco are low it is hard for Moroccan to get a tourist visa

they both have to show they own property,  have a job,  and saved money to pay for the trip on their own

And CO will tell them its easier for you to take the kids to Morocco for them to see

Thank you very much for the fast response, I appreciate it! I didn't think it would be an issue for my mom since she is a bit old but I did have some reservations in regards to my brother, since he is younger! It does make sense that they would ask for me to take the kids to Morocco to see the family, but the idea is also for my mom to see the United States as well. My mom visited Switzerland to see my sister and her children twice in the past without any issues when should could travel all by herself. I am not sure if the fact that she have been overseas before and went back to morocco would help her chances. This is why I am asking because this is all new to me! I do know that it is way harder for younger generation to get a tourist Visa according to my coworkers. I appreciate you all, Thank you!

Yes I would confirm that my mom have no intentions to stay here in the U.S. She is old school, and way too attached to her roots and i think that is wonderful!

Just our experience talking here

we tried for tourist visa for his mom and was denied / her name not being on the family house although it was left to all the kids (and they never went thru the process of the title)   and she never worked / we support her in a new apartment but in Adil's name

and the brother,  has little chance as they will assume he intends to stay and AOS  and it doesn't matter how much you or they say about just a visit /  too many do that and AOS to stay and ruins the tourist visa for you all

Hi Jeannie, Thank you for the response, I appreciate your time! If you don't mind me asking, how old is Adil's mom? I've heard some of my coworkers talking about how easy it is for older people (60+) to get a visitor's visa to the U.S and that they also have a much higher chance of obtaining one (As you have just confirmed, this isn't the case!)

 

My mom owns the house, my brother doesn't.  They both have no working experience in the corporate world but getting cash from odd jobs here and there like most Moroccans tend to do. I am almost wondering if it's easier to sponsor them to get an immigration status then use their cards to visit. Again, this is all new to me so I am willing to learn and try different things! I appreciate you and Adil's being here and helping!

Don't do that.  It would just be a massive waste of time and money if they only intend to visit.  Filing fees, medical fees, travel and other costs to get all the necessary paperwork.  Plus around 2+ years of waiting for your mom's visa and 15+ years for your brother's.  Your kids could be adults by the time they get to see your brother if you try for the immigrant visa route.
