I751 returned for incorrect fee!

Hi Everyone,

 

I’m so confused right now. I sent a check for $595 for my wife’s I751 and it was returned to me stating I sent the incorrect fee! I know about the $85 biometrics fee but the instructions state:

If you are the U.S. citizen or lawful permanent resident spouse, you do not need to include a biometric services fee at the time this petition is submitted.
 

My wife is a lawful permanent resident spouse so I did not include the $85 which I’ve read in other places to not include. Am I missing something or did USCIS mess up?


Also, when I resubmit do I just send in the same papers again without altering again?

 

Any insights is greatly appreciated.

Nevermind, I feel so stupid! Probably should've read this whole thread before I assumed it was $595! 

I should've sent in the biometrics fee. Now the question is, can I just send in the same package they sent back to me? There are some things they've added to the bottom of each page so I'm thinking I should reprint it all?

Same thing happened to my friend a couple of months ago his petition was resent due to incorrect fees, he bought money order for $680 and resent full package, few weeks later he received a letter stating that they will be using his biometrics for aos petition and they never refunded his $85. Guess you will be paying 85 bucks to the state for free.

Yes, you missed something. Your spouse, a conditional resident, who is filing for ROC is the petitioner. You are the USC spouse of the petitioner. It's saying you do not need to pay for the biometrics at this time. Your wife needs to pay the biometrics fee. You can resend the package just with the revised fee.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Why would they refund the biometrics fee? It is not only to capture biometric information. Every time an immigrant apply for certain status, they are required to complete background checks before a status is adjudicated. Reusing biometrics information IS NOT reusing background checks. They reuse the previously captured information, fingerprints, picture, signature. That is all it does, now they have to run background checks again using that previously captured information. And guess what? It is not free, it cost money to run those background checks! So if they return that fee, they won’t be able to tun background checks and no status can be adjudicated.
