I-864- 2020 tax file not received yet

Hello,

I'm in process of filing I-864 at NVC stage. However, I have not received my tax file for 2020. Would NVC accept 2017, 2018 and 2019 tax documents, or would they ask for the last year as well? Could anyone provide suggestion on this.

I paper filed but hasn't been processed by IRS. Alternatively, If I file 864EZ- Do you know if w2 alone is enough?

The form instructions contain a wealth of information.  The last paragraph specifically answers your question above.

 

Item Numbers 23.a. - 25. Federal Income Tax Return Information. You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years. You are not required to have the IRS certify the transcript or photocopy unless specifically instructed to do so by a Government official; a plain transcript or photocopy is acceptable. Do not submit copies of your state income tax returns. Do not submit any tax returns that you filed with any foreign government unless you claim that you were not required to file a Federal individual income tax return with the United States Government and you wish to rely on the foreign return solely to establish the amount of your income that is not subject to tax in the United States.

 

If you provide a photocopy of your Federal individual income tax returns, you must also include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.

Thank you for the information. Do you think I can just submit 2019, 2018 and 2017 since IRS still hasn't processed 2020 tax returns?

Only one year is required not three.  You send the most recent.   In your situation, you will send a copy of your complete 2020 papet return including W2's

No, the I-864 requires the tax return or transcript from the most recent tax year.  That would be 2020.

Correct.  You will not read ANYTHING in the instructions about whether the IRS has processed your return.  It doesn't matter.  Submit a complete copy including all forms, W2 and 1099.  If the Tax Return Transcript becomes available before the interview, bring it to the interview.  If you think submitting 2018 and 2019 will help your case, submit them too.  If not, just the 2020 and a current pay stub will do nicely.  Note that your current income does not come from a tax return.  It comes from and is documented with your pay stub.

Facts are cheap...knowing how to use them is precious...

Thank you for your input. I will add a cover letter as to explain that I have filed 2020 tax and it's in progress with IRS. Yes I plan to add W2, 1099, pay stubs for last 6 months and employment letter from my employer as well.

No need for a cover letter or more than the latest pay stub.  Pay stubs have contained YTD information for a couple decades now.
