Hello! My partner and I are preparing to get a CR-1 visa for myself (I'm from Europe). My partner is unemployed and studying free training courses online for certifications. Can we specify that she is a student?

 

She has 0 income. Would that hurt our chances at a CR-1 approval if we have a joint sponsor (a parent) who makes 40k salary? Would that be enough to apply for a joint sponsor?

 

Also, would my career/educational background help in being a lower / lesser risk of being a public charge?

Depends on the parent's household size. Does he have any dependents and/or spouse?

That should be fine. Some embassies would like to see the i864A from the spouse of the joint sponsor if they file taxes jointly.

Yes, it is the best practice.  40k is enough for a household of 4, but marginal.

Facts are cheap...knowing how to use them is precious...

My wife is a FT student and makes no money. She filled I-864 and stated all of that when asked on the form, and her Dad also did I-864 (NOT I-864A). He makes over the threshold, so this was accepted without any issues.

 

Make sure your spouse still includes their tax return they got/gets from the IRS. It's essential even if they didn't work a single minute that year.
